11.08.010 - Installation and maintenance.

A. The city engineer or his duly authorized representative has the exclusive power and duty to place and maintain or cause to be placed and maintained official traffic-control devices when and as required under the provisions of this chapter and other traffic ordinances of the city to make effective such provisions.

B. Whenever the Vehicle Code of the state requires for the effectiveness of any provision thereof that traffic-control devices be installed to give notice to the public of the application of such law, the city engineer is authorized to install the necessary devices subject to any limitations or restrictions set forth in the law applicable thereto.

C. The city engineer may also place and maintain such additional traffic-control devices as he may deem necessary to regulate traffic and to guide or warn traffic, but he shall make such determination only upon the basis of traffic engineering principles and traffic investigations and in accordance with such standards, limitations and rules as may be set forth in this chapter and other traffic ordinances of the city or as may be determined by ordinance or resolution of the city council.

D. The city engineer shall ascertain and determine the locations where traffic signals are required by resort to field observation traffic counts and other traffic information as may be pertinent and his determination therefrom shall be made in accordance with those traffic engineering and safety standards and instructions set forth in the California Traffic Manual issued by the State Department of Transportation.

E. The intersections and other locations where traffic signals are presently located are shown on the traffic-control map, established pursuant to the provisions of Section 11.04.020 and on file in the office of the city clerk.

F. Whenever, pursuant to this chapter, the city engineer or his duly authorized representative shall order or authorize traffic-control regulations or devices which require posting to be legally enforceable, it shall be the duty of the public works department to erect and maintain the necessary signs and devices to advise the public of the existence of such regulations.

G. Decisions of the city engineer or his duly authorized representative with regard to traffic-control devices may be appealed to the board of administrative review (BAR) upon receipt of a written appeal to the city engineer within ten days of notification of the decision. Decisions of BAR may be appealed to the city council upon receipt of a written appeal to the city clerk within ten days of notification of the appeal decision.

11.08.020 - Sign legibility.

No provision of the state Vehicle Code or of this chapter for which signs are required shall be enforceable against the alleged violator if, at the time and place of the alleged violation, the signs required in this chapter are not in proper position and sufficiently legible to be seen by an ordinarily observant person.

11.08.030 - Signals on state highways.

Whenever traffic signals are installed on a state highway, the hours of operation, cycle and intervals shall be as approved from time to time by the division of highways of the state and shall be subject to change whenever so ordered by that department.
