11.04.010 - Definitions.

A. Whenever in this title the following terms are used, they shall have the meanings respectively ascribed to them that are set forth in the California Vehicle Code:

  1. Alley;

  2. Business district;

  3. Crosswalk;

  4. Driveway;

  5. Intersection;

  6. Loading zone;

  7. Operator;

  8. Park;

  9. Parking area;

  10. Roadway;

  11. Safety zone;

  12. Sidewalk;

  13. Street;

  14. Traffic;

  15. Vehicle.

B. Whenever in this title the following term is used, it shall have the meaning respectively ascribed to it in this Chapter:

  1. "Automated License Plate Recognition" (ALPR) means technology that can automatically detect vehicles' license plates, read the plate numbers, and record the plate number, date, time, and geographical location of the vehicles.

  2. "Block face" means the block in which the vehicle is parked, bordered by an intersection at each end.

  3. "Digital parking permit" means a non-physical parking permit that is associated with at least one vehicle's license plate number.

  4. "Employee parking permit zone" means a street, portion of a street, or other public or private parking areas established as a zone in which the parking of vehicles is limited to those who obtain an employee parking permit.

  5. "No re-park" means a vehicle that has parked longer than the posted time limit cannot be moved to park within the same block face or parking facility after the expiration of the maximum posted time limit. A vehicle may not return to the initial block face or parking facility sooner than two hours following the expiration of the initial time period.

  6. "Paid parking device" means any device used to accept payment for parking, such as parking meters, pay stations, mobile devices, or other methods approved by the city engineer, or his/her designee.

  7. "Paid parking zone" means a street, portion of a street, or other public or private parking areas established as a zone in which the parking of vehicles or other uses authorized upon such street or other public parking area is regulated by a paid parking device.

  8. "Parking facility" means the area set aside for the storage and parking of vehicles including parking lots and garages.

  9. "Parking space" means a space in a parking facility or in a public right-of-way, street, alley, or roadway that is designed for the leaving of a vehicle.

  10. "School bus" means a bus that transports students from home to school, school to home, or to school-sponsored events.

  11. "Time limited parking zone" means a group of parking spaces on a public right-of-way or on city-owned or operated property that are delineated by a posted sign and for which allowed duration of parking is limited.

  12. "Traffic control map" means the traffic control map adopted by the city council and maintained on file in the office of the city clerk and all notations and information set forth thereon pertaining to the regulation and control of traffic in the city.

11.04.020 - Map adopted.

A. That certain document entitled "Traffic Control Map" is adopted as part of this chapter regulating motor vehicles and traffic, and the "Traffic Control Map" and all notations and information thereon are made a part of this chapter by reference. Copies of the map shall be maintained on file in the office of the city clerk.

B. The city council may amend the traffic control map by resolution from time to time to further regulate and control traffic.

11.04.030 - Persons authorized to direct traffic.

Officers of the police department are authorized to direct all traffic by means of visible or audible signal. It is unlawful for any person to refuse or fail to comply with any lawful order, signal or direction of a traffic or police officer, or at any school crossing to refuse or fail to comply with any order, signal or direction of any person appointed by the police department to control traffic at school crossings who shall at the time be wearing some insignia indicating such appointment. It is unlawful for any minor to direct or attempt to direct traffic unless authorized to do so by order of the chief of police.

11.04.040 - Vehicle removal from public streets and spaces.

A. Pursuant to California Vehicle Code section 22651, peace officers and regularly employed and salaried employees engaged in directing traffic or enforcing parking laws may remove or cause to be removed the following:

  1. Any vehicle that has been parked or left standing on a street or alley for more than a consecutive period of seventy-two hours;

  2. Any vehicle which is parked or left standing on a street or alley, or any portion thereof, when the use of the street or alley is authorized for a purpose other than the normal flow of traffic, or for the movement of equipment, articles or structures of unusual size, and the parking of the vehicles would prohibit or interfere with the use or movement; provided that signs giving notice that the vehicles may be removed are erected or placed at least twenty-four hours prior to the removal;

  3. Any vehicle which is parked or left standing in any off-street parking facility owned or operated by the city for more than seventy-two consecutive hours, provided that conspicuously-placed signs giving notice that vehicles may be removed are erected at least thirty days prior to the implementation of this provision.

B. Removal of any such vehicle shall be to a garage designated by the chief of police and shall be in accordance with the requirements of the California Vehicle Code section 22651.

11.04.050 - Emerging from alley or driveway.

The operator of a vehicle emerging from an alley, driveway, or garage shall stop the vehicle immediately prior to traveling onto a sidewalk or onto the sidewalk area extended across any alleyway.

11.04.060 - Emergency vehicle exemption.

A. The provisions of this title regulating the movement, parking and standing of vehicles shall not apply to ambulances, vehicles of the electrical department, fire department, police department, sheriff's office, or of a public utility while the driver of any such vehicle is engaged in the necessary performance of emergency duties.

B. The foregoing exemptions shall not, however, protect the driver of any such vehicle from the consequences of his willful disregard for the safety of others.

11.04.070 - One-way street designation authority.

In addition to the one-way streets and alleys designated in Chapter 11.16, the council may designate other streets, alleys or portions thereof as one-way streets or alleys by resolution.

11.04.080 - Stopping at school pedestrian crossing.

It is unlawful for any person driving or operating, propelling or causing to be propelled any vehicle to fail to stop within fifty feet of the nearest side of a school pedestrian lane where any signal device, flagman or other person is stationed giving warning that children are about to or are crossing the street; and it is further declared unlawful to proceed until the signal has stopped, raised or been removed or the flagman or person stationed at the pedestrian lane has given a signal to go or has left the locality.

11.04.090 - Stop intersections.

Every operator of a motor vehicle approaching an intersection or other location where stops are required for his direction of approach and where official stop signs have been installed as authorized by the city council pursuant to California Vehicle Code Section 21354, and as are illustrated and designated on the traffic control map established by Section 11.04.020 and on file in the office of the city clerk, shall bring the vehicle to a complete stop at the place and prior to the point designated for the stop.

11.04.095 - Yield right-of-way signs.

Every operator of a motor vehicle approaching an intersection or other location where a yield is required for his direction of approach, and where an official yield sign has been installed as authorized by the City Council pursuant to California Vehicle Code Section 21356, and as are illustrated and designated on the traffic control map established by Section 11.04.020 and on file in the office of the city clerk, shall yield the right-of-way to other vehicles which have entered the intersection from an intersecting street or which are approaching so closely on the intersecting street as to constitute an immediate hazard and shall continue to yield the right-of-way to such approaching vehicles until such time as he can proceed with reasonable safety.

A driver, having so yielded, may then proceed, and the drivers of all other vehicles approaching the intersection on the intersecting roadway shall yield the right-of-way to him.

11.04.100 - U-turns prohibited where.

A. It is unlawful for the operator of any vehicle to turn so as to proceed in the opposite direction at any of the following places:

  1. When eastbound on Cypress Avenue, upon entering the intersection with the west leg of Akard Avenue;

  2. When eastbound or westbound on Cypress Avenue, upon entering the intersection with Athens Avenue and Park Marina Drive;

  3. When westbound on Cypress Avenue, upon entering the intersection with Henderson Road;

  4. When eastbound or westbound on Cypress Avenue, upon entering the intersection with Hilltop Drive;

  5. When southbound on Hilltop Drive, upon entering the intersection with Dana Drive;

  6. When eastbound or westbound on Dana Drive, upon entering the intersection with State Highway Route 44 on and off ramps;

  7. At other locations which the city council may subsequently designate by ordinance.

B. The city engineer shall cause to be installed and maintained authorized signs prohibiting such movements.

11.04.110 - Left turns prohibited where.

A. It is unlawful for the operator of any vehicle to make a left turn at any of the following places, in addition to left turns against traffic on one-way streets:

  1. When eastbound or westbound on Cypress Avenue, when entering the intersection with Athens Avenue and Park Marina Drive;

  2. When northbound on Akard Avenue, upon entering the intersection with Cypress Avenue;

  3. At other locations which the city council may subsequently designate by ordinance.

B. The city engineer shall cause to be installed and maintained authorized signs prohibiting such turns.

11.04.120 - State highway regulation.

A. Any provision of this code which regulates traffic or delegates the regulation of traffic upon state highways in any way for which the approval of the Department of Transportation is required by state law, shall cease to be operative six months after receipt by the city council of written notice of withdrawal of approval of the Department of Transportation.

B. Whenever this code delegates authority to a city officer, or authorizes action by the city council to regulate traffic upon a state highway in any way which by state law requires the prior approval of the Department of Transportation, no such officer shall exercise such authority, nor shall such action by the city council be effective with respect to any state highway without the prior approval in writing of the Department of Transportation when and to the extent required by Division 11 of the Vehicle Code.

11.04.130 - Traffic on bridges.

A. The city council may, by resolution, prohibit, restrict, or regulate traffic on bridges and viaducts in the city.

B. When signs are in place giving notice thereof, all traffic shall comply with the directions of such signs.

11.04.140 - Violations.

Any violation of any of the provisions pertaining to parking, contained in Chapter 11.24 or Chapter 11.28, constitutes an infraction.

11.04.150 - Alteration of tire marking evidence prohibited—Penalty.

It is unlawful for any person to remove, erase, deface, obliterate, alter, or render unusable for the purposes of enforcing the provisions of this title any chalk mark, marker, or other device placed on a vehicle or any portion thereof by a city employee for the purpose of measuring the passage of time of a vehicle stopped, standing or parked on any street or parking lot. Violation of this section constitutes an infraction.
