13.04.005 - Rules and regulations.¶
The provisions contained in Title 13 of this code are intended to regulate the construction, use and service of the utility systems of the city, to include all work and activities relating to construction, demolition, abatement, subdivision and other activities necessitating the service and use of utilities generally, and water and sewer specifically. In the event any section or provision contained in Title 13 is declared unconstitutional or invalid, the remaining sections or provisions shall remain in full force and effect.

13.04.010 - Incorporation of Uniform Codes.¶
A. In addition to the provisions set forth in this title, the definitions and provisions of the Uniform Codes set forth hereinafter are adopted and incorporated in this section. In the event of a conflict or discrepancy in the provisions of this title and the Uniform Codes, the provisions in the Uniform Codes shall prevail. The Uniform Codes most recently adopted by the city shall be the prevailing Uniform Codes and all provisions are incorporated herein as though set forth in verbatim.
B. The provisions of the following Uniform Codes are incorporated in this title.
Uniform Plumbing Code;
Uniform Building Code;
Uniform Mechanical Code;
Uniform Fire Code;
Uniform Housing Code;
Uniform Sign Code;
Uniform Code for Abatement of Dangerous Buildings;
National Electrical Code.

13.04.015 - Licensed contractor—Responsibility for work.¶
All contractors shall be held strictly responsible for any and all acts of agents or employees. Upon being notified by the inspector of defects in the utility system of a building, or of any violation of this chapter, the person or persons having charge of such work shall immediately correct the same.

13.04.020 - Use of licenses.¶
No contractor shall allow his professional registration or license to be used in any manner to obtain a permit from the city, other than for his own use. The city shall have the right to suspend or revoke any permit issued in violation of this section.

13.04.025 - Water system.¶
The city will furnish a system, plant, works and undertaking, used for and useful in obtaining, conserving and disposing of water for public and private uses, including all parts of the enterprise, all appurtenances to it, and lands, easements, rights in land, water rights, contract rights, franchises, and other water supply, storage and distribution facilities and equipment.

13.04.030 - Pressure conditions.¶
All applicants for service connections or water service shall be required to accept such conditions of pressure and service as are provided by the distribution system at the location of the proposed service connection. The city will not be responsible for any damages arising out of low pressure, high pressure conditions, or interruptions in service.

13.04.035 - Maintenance.¶
The city does not accept any responsibility for the maintenance of pressure and it reserves the right to discontinue service while making emergency repairs, etc. Consumers dependent upon a continuous supply of water must provide emergency storage.

13.04.040 - Tampering.¶
No one except an employee or representative of the city shall at any time in any manner operate the curb cocks or valves, main cocks, gates or valves of the city's system, or interfere with meters, their connections, street mains, or other parts of the water system.

13.04.045 - Rulings final.¶
All rulings of the city administrator shall be final, unless appealed in writing to the council within ten calendar days. When appealed, the council's ruling shall be final.

13.04.050 - Water meters.¶
The city reserves the right, subject to duly noticed hearing by publication and posting of notice, to require the installation of metering devices to determine the use, flow and volume of water consumed by users inside the city limits as well as users outside the city limits using the utility service of the city.

13.04.055 - Establishment of fees, charges and rates.¶
Except as otherwise provided in this chapter, the rates, charges, fees and costs which the city shall charge for opening and closing service connections, hookup fees, monthly rates, penalties, repair costs and other charges resulting from and related to utility use and services, shall be set from time to time by resolution.

13.04.060 - Establishment of policies, procedures, rules and regulations.¶
The city may adopt, modify and amend policies, procedures, rules and regulations relating to utilities and utility billing from time to time by resolution.
