A. The provisions of this chapter prohibiting the stopping, standing or parking of a vehicle shall apply at all times or at those times herein specified, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.

B. The provisions of this chapter imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the state Vehicle Code or the ordinances of this city prohibiting or limiting the standing or parking of vehicles in specified places or at specified times. 17-10.1: STOPPING OR STANDING IN PARKWAYS PROHIBITED:

No person shall stop, stand or park a vehicle within any parkway. (Ord. 1162 § 1, 12-5-1978)

17-10.2: TRAFFIC ENGINEER TO MAINTAIN NO STOPPING ZONES AND NO PARKING AREAS:

The city traffic engineer is hereby authorized to maintain, by appropriate signs or by paint upon the curb surface, all no stopping zones, no parking areas and restricted parking areas as defined and described in this chapter.

When said curb markings or signs are in place, no operator of any vehicle shall stop, stand or park such vehicle adjacent to any such legible curb marking or sign in violation of any of the provisions of this chapter. (Ord. 1162 § 1, 12-5-1978)

17-10.3: NO PARKING AREAS:

No operator of any vehicle shall stop, stand, park or leave standing such vehicle in any of the following places except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or other authorized officer, or traffic sign or signal:

A. Within any divisional island unless authorized and clearly indicated with appropriate signs or markings.

B. On either side of any street between the projected property lines of any public walk, public steps, street or thoroughfare terminating at such street when such area is indicated by appropriate signs or by red paint upon the curb surface.

C. In any area where the city traffic engineer determines that the parking or stopping of a vehicle would constitute a traffic hazard or would endanger life or property when such area is indicated by appropriate signs or by red paint upon the curb surface.

D. In any area established by resolution of the council as a no parking area when such area is indicated by appropriate signs or by red paint upon the curb surface.

E. Upon, along or across any railway track in such manner as to hinder, delay or obstruct the movement of any car traveling upon such track.

F. In any area where the parking or stopping of any vehicle would constitute a traffic hazard or would endanger life or property.

G. On any street or highway where the use of such street or highway, or a portion thereof, is necessary for the cleaning, repair or construction of the street or highway or the installation of underground utilities; or where the use of the street or highway or any portion thereof is authorized for a purpose other than the normal flow of traffic; or where the use of the street or highway or any portion thereof is necessary for the movement of equipment, articles or structures of unusual size and the parking of such vehicle would prohibit or interfere with such use or movement; provided, that signs giving notice of such prohibited parking are erected or placed at least twenty four (24) hours prior to the effective time of such no parking.

H. At any place within twenty feet (20') of a point on the curb immediately opposite the mid block end of a safety zone when such place is indicated by appropriate signs or by red paint upon the curb surface.

I. At any place within twenty feet (20') of a crosswalk at an intersection (in the central traffic district) or in any business district when such place is indicated by appropriate signs or by red paint upon the curb surface, except that a bus may stop at a designated bus stop.

J. Within twenty feet (20') of the approach to any traffic signal, boulevard, stop sign or official electric flashing device. (Ord. 1162 § 1, 12-5-1978)

17-10.4: USE OF STREETS FOR STORAGE OF VEHICLES PROHIBITED:

No person who owns or has possession, custody or control of any vehicle shall park such vehicle upon any street or alley for more than a consecutive period of seventy two (72) hours. (Ord. 1162 § 1, 12-5-1978)

17-10.5: PARKING FOR DEMONSTRATION:

No operator of any vehicle shall park said vehicle upon any street in this city for the principal purpose of advertising or displaying it for sale unless authorized by resolution of the council. (Ord. 1162 § 1, 12-5-1978)

17-10.6: REPAIRING OR GREASING VEHICLES ON PUBLIC STREETS:

No person shall construct or cause to be constructed, repair or cause to be repaired, grease or cause to be greased, dismantle or cause to be dismantled any vehicle or any part thereof upon any public street in this city. Temporary emergency repairs may be made upon a public street. (Ord. 1162 § 1, 12-5-1978)

17-10.7: WASHING OR POLISHING VEHICLES:

No person shall wash or cause to be washed, polish or cause to be polished any vehicle or any part thereof upon any public street in this city when a charge is made for such service. (Ord. 1162 § 1, 12-5-1978)

17-10.8: PARKING ADJACENT TO SCHOOLS:

A. The city traffic engineer is hereby authorized to erect signs indicating no parking upon that side of any street adjacent to any school property when such parking would, in his opinion, interfere with traffic or create a hazardous situation.

B. When official signs are erected prohibiting parking upon that side of a street adjacent to any school property, no person shall park a vehicle in any such designated place. (Ord. 1162 § 1, 12-5-1978)

17-10.9: PARKING PROHIBITED ON NARROW STREETS:

A. The city traffic engineer is hereby authorized to place signs or markings indicating no parking upon any street when the width of the roadway does not exceed twenty feet (20') or upon one side of a street as indicated by such signs or markings when the width of the roadway does not exceed thirty feet (30').

B. When official signs or markings prohibiting parking are erected upon narrow streets as authorized herein, no person shall park a vehicle upon any such street in violation of any such sign or marking. (Ord. 1162 § 1, 12-5-1978)

17-10.10: PARKING ON GRADES:

No person shall park or leave standing any vehicle unattended on a highway when upon any grade exceeding three percent (3%) (within any business or residence district) without blocking the wheels of said vehicle by turning them against the curb or by other means. (Ord. 1162 § 1, 12-5-1978)

17-10.11: EMERGENCY PARKING SIGNS:

A. Whenever the city traffic engineer or chief of police shall determine that an emergency traffic congestion is likely to result from the holding of public or private assemblages, gatherings, or functions, or for other reasons, the city traffic engineer or chief of police shall have power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys as the city traffic engineer or chief of police shall direct during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency and the city traffic engineer or chief of police shall cause such signs to be removed promptly thereafter.

B. When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs. (Ord. 1162 § 1, 12-5-1978)

17-10.12: PARKING VEHICLES FOR SALE ON STREET PROHIBITED; SALE OF MERCHANDISE FROM…

It shall be unlawful for the operator of any vehicle to park the same upon any street for the purpose of displaying it for sale or to park any vehicle upon any street in any business district from which such vehicle merchandise is being sold. (Ord. 1162 § 1, 12-5-1978)

17-10.12.1: PROHIBITED ON PRIVATE PROPERTY WITHOUT CONSENT OF OWNER; APPLICABILITY OF…

A. No person shall park or operate a vehicle upon a private driveway or upon private property within the city without the actual or implied consent of the owner or person in lawful possession of such driveway or said persons, agents, or employees; nor shall a person continue to park or operate a vehicle upon such driveway or property, once said consent has been withdrawn.

B. The provisions of subsection A of this section shall be effective on commercial property only if there is displayed a sign prohibiting parking or driving without the consent of the owner or person in possession of said property. For purposes of this section "commercial property" is property used for or in connection with a business for profit. (Ord. 1233 § A, 3-17-1981)

17-10.12.2: RESTRICTIONS ON VEHICLE VENDORS; PUSHCARTS ON PUBLIC RIGHT OF WAY:

A. Except as otherwise provided in this section, no person shall stand or park any vehicle, wagon, or pushcart from which goods, wares, merchandise, fruits, vegetables or foodstuffs are sold, displayed, solicited or offered for sale or bartered or exchanged, or any lunch wagon or eating cart or vehicle, on any portion of any street, parking lot, or public right of way within this city except that such vehicles, wagons, or pushcarts may stand or park only at the request of a bona fide purchaser for a period of time not to exceed ten (10) minutes at any one place.

B. No person shall vend at any location for more than ten (10) minutes without moving to a new location at least three hundred feet (300') removed therefrom and may not return to a location where the vendor has stopped to vend within the previous two (2) hours.

C. Routes of vendors shall be restricted to minor residential streets:

  1. Pushcarts (walking type) shall be restricted to walkways, sidewalks and other areas appropriate to accommodate pedestrian traffic.

  2. Pushcarts (riding type) shall be restricted to vehicular travel areas and shall be prohibited from utilizing pedestrian walkways.

D. Hours of operation shall be restricted to nine o'clock (9:00) A.M. to eight o'clock (8:00) P.M.

E. Sounds produced in association with vending shall be restricted as follows:

  1. Pushcarts of any type shall be limited to bells only.

  2. Vehicles shall be in compliance with chapter 3, article III of this code.

F. Vending in connection with any special event as permitted by the city council shall be exempt from the provisions of this section. (Ord. 1531 § C1, 6-18-1996)

17-10.12.3: VIOLATIONS AND PENALTIES:

Any person violating section 17-10.12.2 of this article or any provisions thereof shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not exceeding five hundred dollars ($500.00) or by imprisonment for a term not exceeding six (6) months, or by both such fine and imprisonment. Each day that any provision of this article is violated is a separate and distinct offense and shall be punishable as a separate and distinct offense. Notwithstanding the classification of a violation of this article as a misdemeanor, at the time an action is commenced to enforce the provisions of this article, the trial court, upon recommendation of the prosecuting attorney, may reduce the charged offense from a misdemeanor to an infraction. Any person convicted of an infraction under this article shall be punished by:

A. A fine not exceeding fifty dollars ($50.00) for a first violation;

B. A fine not exceeding one hundred dollars ($100.00) for a second violation of this article within one year; and

C. A fine not exceeding two hundred fifty dollars ($250.00) for each additional violation of this article within one year. (Ord. 1531 § C2, 6-18-1996)

17-10.13: PARKING IN CITY PARKS:

A. Regulated: No person shall operate, drive, stop, park or leave standing any motor vehicle, other than on paved roadways or paved parking areas, in any city park, except when in possession of a permit issued by the director of parks and leisure services permitting that person to operate, drive, stop, park or leave standing said motor vehicle, and further, except any motor vehicle being operated, driven, stopped, parked or left standing by a city employee in the course and scope of his or her duties.

B. Permit: A permit may be obtained from the city to park on other than paved roadways or paved parking areas at the aforementioned city parks. The party requesting such permit shall apply to the director of parks and leisure services for such permit, on a form specified by that department, for any person or group activity, no less than five (5) working days prior to the requested date.
