5118 - License—Required.

(a) No person shall conduct a patio, garage or yard sale unless they first obtain a license therefor.

(b) A "patio, garage and/or yard sale" for the purpose of this Chapter means a sale of personal property held at a private residence by the owner, owners, tenants or occupants thereof, and is limited to the sale of property owned exclusively by those conducting such sale.

5119 - License—Application.

No license to conduct a patio, garage and/or yard sale shall be granted except upon written application to the License Officer made at least one day prior to the date of the sale. Each application shall set forth and contain the following:

(a) The name of the licensee and address of the licensee;

(b) The date of the sale and hours of the sale; and

(c) The general description of the type of merchandise to be sold and the prices.

5120 - License—Fee.

All license fees specified in Section 5031 shall be paid prior to the issuance of a license under this part.

5121 - Sales—Frequency and duration.

No person shall conduct a garage and/or yard sale at any location more frequently than twice per calendar year, nor shall any such sale be conducted for a period in excess of two consecutive days.

5122 - Inspection by police department.

All goods, products and merchandise offered for sale at a patio, garage and/or yard sale shall be made available for inspection by any representative of the Police Chief at the place where the sale is to be conducted, and, if requested by the representative, the person conducting the sale shall establish evidence of title to the goods, products and merchandise offered for sale.

5123 - Advertising.

Except as expressly provided in this Chapter, no sign, placard or other form of advertisement of patio, garage and/or yard sale shall be placed upon any property within the City. No sign, placard or other form of advertisement shall be placed upon the premises where the sale is to be conducted more than two days prior to the day the sale is to commence, and shall be removed by 6:00 p.m. on the day the sale terminated. No more than two signs, placards or other form of advertisement shall be placed upon the premises used for such sale, and shall not exceed three square feet in size.

5124 - Hours of sale.

No patio, garage and/or yard sale shall be commenced prior to 8:00 a.m. and conclude each day no later than 6:00 p.m.
