4301 - Electric/motorized vehicles.

Unless otherwise authorized by the City, no person shall ride, push or pull any electric/motorized vehicle on the Pier except for electric/motorized vehicles designed and used to assist handicapped or disabled persons. Electric/motorized vehicles are defined as a wheeled vehicle that is propelled primarily by an electric motor. This shall include but not be limited to vehicles, cars, trucks, motorcycles, scooters and electric bicycles.

4302 - Dropping refuse from pier or wharf.

It shall be unlawful for any person to drop, sweep, brush, cast or throw any paper, litter, garbage or debris of any kind or nature whatsoever from the pier or any part thereof, into the waters of the Pacific Ocean or onto the beach under or adjacent to the pier or wharf.

4303 - Refuse on pier or wharf.

It shall be unlawful for any person to leave any paper, fish, fish bait, clam shells or the remnants from cleaning any fish or any other debris of any kind or character upon the wharf or pier. Every person bringing the same or any luncheon, or any fish bait or tackle upon the pier or wharf shall keep the same in a receptacle or package, and when leaving the pier or wharf, shall remove the same from the pier or wharf and leave thereon no litter or debris of any kind.

4304 - Defacing pier or wharf.

It shall be unlawful for any person to write, cut, mark, stain, remove or otherwise deface any portion of the pier or wharf or any building or attachment thereon.

4305 - Tampering with life saving equipment.

It shall be unlawful for any person to unwind, remove or in any way tamper with any lifeguard tower, storage facility, buoy, life line, rope, reel, or other paraphernalia connected with any life saving apparatus on the pier unless it is to use the same for the purposes for which they are intended and only for the purpose of attempting to rescue or save any person in actual or apparent danger.

4306 - Fishing on the pier.

The following rules apply to fishing from the pier:

(a) No person shall cut any bait or fish upon any bench upon the pier.

(b) No person shall cast a line with any weight, and/or hook, and/or bait attached thereto by swinging the same above the railing on the pier or by swinging or casting a line overhead or sidearmed from a pole or from the hands.

(c) No person shall set, draw or use any fishing net or seine in the Pacific Ocean for purpose of catching fish at a point or place within five hundred (500) feet of the pier.

4307 - Mooring at the pier.

No person shall attach any boat or line to the pier except by permit of the Director.

4308 - Meddling with the pier.

No person except those authorized by the Director shall remove mussels or in any way meddle with the pilings or any other portion of the pier.

4309 - Surfing and scuba diving.

No person shall swim, operate or otherwise use a surfboard, skin dive or use self-contained breathing apparatus within an area of one hundred (100) feet of the pier without first obtaining permission from the Director.

4310 - Jumping from pier.

No person shall jump, dive, or throw himself or herself from the City of Port Hueneme pier into the Pacific Ocean unless required by an emergency to do so.

4311 - Camping on pier or wharf prohibited.

It shall be unlawful for any person to cook food except within designated areas, camp, or occupy camp facilities in or along the Beach Park. A violation of this section may be enforced according to the provisions of Sections 1100 through 1111 of this Code.

4312 - Removal and storage of personal property.

(a) It shall be unlawful for any person to store personal property, including camp facilities and camp paraphernalia, on or along the pier or wharf.

(b) The City may remove personal property unlawfully stored or found on or along the pier or wharf in accordance with Sections 3976 through 3979.

4313 - Enforcement.

This Chapter shall be enforced pursuant to Section 4003 and Chapter 2 of Article I of this Code.

4314 - Definitions and prohibition of smoking on wharf or pier.

(a) For purposes of this section, the definitions contained within Section 4215 of Chapter 3 of Article IV shall apply.

(b) It shall be unlawful to smoke any tobacco product or cannabis on or within the areas of the wharf or pier. A violation of this section is to be enforced by citation issued in accordance with Section 4003 and Chapter 2 of Article I of this Code by a fine of not less than sixty-five dollars ($65.00).
