4001 - Definitions.

The following words, phrases and terms as used in this Article, shall have the meanings as indicated:

(a) "Beach" means all that portion of land adjacent to the Pacific Ocean within the City limits including the bicycle path and all public improvements thereon.

(b) "Director" as used in this Article means the Director of Recreation and Community Services of the City or other person authorized by him pursuant to law to act in his stead.

(c) "Vessel" means every type of watercraft, other than a seaplane on the water, used or capable of being used as a means of transportation on water and includes a raft, but does not include a surfboard, paddle board or a standard surf mat.

(d) "Pier" means that certain pier owned by the City which extends into the Pacific Ocean from the Port Hueneme Beach.

(e) "Wharf" means all wharves owned and managed by the Port Hueneme Harbor District.

(f) "City parks" means all of the following: Bolker Park, Bubbling Springs Park, Beach Park, Moranda Park, Recreation Greenbelt improvements, Seaview Apartments Playground.

(g) "City Recreation Buildings" means all of the following: Athletic Center Facility, Community Center Facility, Dorill B. Wright Cultural Center, Ray Prueter Library, Port Hueneme Museum, Moranda Park Community Center.

(h) "Public Facilities" means the Pier, wharf, city parks and city recreation buildings.

4002 - Compliance.

No person shall enter, be or remain on any public facility unless he or she complies with all of the regulations set forth in this Chapter applicable to such and with all other applicable provisions of this Code.

4003 - Enforcement.

The Director and the Police Chief shall enforce the provisions of this Article. To so enforce the provisions of this Article the Director, Police Chief and their designees may issue citations in accordance with the procedures specified in Article I of this Code.

4004 - At own risk.

Any person exercising any of the privileges authorized by this Article does so at his or her own risk without liability on the part of the City for any injury to persons or property resulting therefrom.

4005 - Exceptions.

The provisions of this Article are not applicable to acts performed:

(a) In an emergency, for the purpose of protecting life or property; or

(b) By City, County, State or Federal employees or other public body maintaining a public facility in the course of their assigned duties; or

(c) When a permit has been granted by the Director or by the Council permitting the otherwise proscribed acts.

4006 - Permit procedure.

Any person or organization desiring a permit to conduct an activity otherwise prohibited by this Article shall file a request for a permit on a form proscribed by the Director. The Director shall respond in writing within a reasonable time if the permit request is denied. Appeals from decisions of the Director shall follow the procedures defined in Article I Chapter 4 of this Code.

4007 - Alcoholic beverages.

No person shall enter, be or remain on any public facility while in possession of, transporting, purchasing, selling, giving away or consuming any alcoholic beverages.

4008 - Animals.

(a) No person shall bring, maintain, ride or lead any animal as defined in Chapter 1 of Article III of this Code, except a guide dog used by the physically handicapped, onto any sandy beach area of the City or on the seaward side of the shorefront paved pathways of Hueneme Beach Park or into the waters of the ocean.

(b) An off-leash dog area within Bubbling Springs Park as depicted on the park construction drawings maintained in the Department of Public Works is hereby designated. Such area shall be fenced and posted for off-leash activity pursuant to the following regulations:

(1) Persons shall use a suitable container or instrument to remove their dog's feces and dispose of it in a sanitary manner in designated waste containers

(2) No person shall harass, tease, or incite any dog in any way, including but not limited to verbal, physical; gestures or throwing of objects.

(3) Dogs exhibiting aggressive behavior towards any person or another animal shall be immediately leashed and removed from the off-leash areas by the person responsible for the dog.

(4) If a dog injures a person or another animal, the person responsible for the dog shall immediately provide the dog owner's name and address, as well as any insurance information requested by or on behalf of the injured person, or by any City employee.

(c) The City Manager may approve additional administrative regulations relating the use of any off-leash area and shall cause all relevant regulations to be prominently posted within or adjacent to the off-leash area.

4009 - Disturbance.

No person shall disturb the peace and quiet of any public facility by:

(a) Any unduly loud or unusual noise, or;

(b) By tooting, blowing, or sounding any automobile siren, horn, signal or noise-making device, or

(c) By any tumultuous conduct; or

(d) By the use of any vulgar, profane or indecent language, therein; or

(e) Lewd, indecent conduct.

4010 - Fires.

No person shall build or maintain any campfires or other fires for any purpose on any public facility, or against or adjacent thereto, or against or adjacent to any public property in the City, excepting however, that the making or kindling of fires in said public facilities shall be permitted in such places as may be designated and set apart therefor by the Council for such purposes.

4011 - Flora and turf, etc.

No person shall dig, remove, destroy, injure, mutilate, or cut any tree, plant, shrub, bloom, flower, or any portion thereof growing on or about any public facility, waterway or body of water. No person shall remove any wood, turf, grass, soil, rock, sand or gravel from any public facility, waterway or body of water.

4012 - Glass, etc.

No person shall place, throw, leave, keep, or maintain any bottle, glass, ceramic, sharp or pointed article or thing in such a manner that any person on or about a public facility is or may be cut, pricked or in any way injured thereby.

4013 - Littering.

No person shall throw, place or dispose of any garbage, refuse, or can in any place on or about a public facility other than into a can or other receptacle maintained therein for that purpose. No person shall throw, place or dispose of any waste paper or combustible refuse in any place on a beach other than into an incinerator or into some box, can, trench or receptacle maintained therein for that purpose.

4014 - Solicitation or peddling.

No person shall solicit, peddle, sell, or offer for sale any goods, wares or merchandise in any portion of the City lying westerly of Surfside Drive except such activity occurring in the city sanctioned concession stand existing at the foot of the Pier.

4015 - Throwing missiles.

No person shall throw or otherwise propel any missile, mud, sand, or dirt anywhere on a public facility.

4016 - Loitering.

No person shall loiter on any public facility between the hours of 10:00 p.m. and dawn of the following day in a manner that is not usual for law abiding individuals under the circumstances and warrants alarm for the safety of persons or property in the vicinity.

4017 - Nudity on or about public facilities.

No person shall appear, bathe, sunbathe, walk or be on any public facility or the waters adjacent thereto in such a manner that the genitals, vulva, pubic symphysis, pubic hair, buttocks, natal cleft, perineum, anus, anal region, or pubic hair region of any person, or any portion of the breast at or below the upper edge of the areola thereof of any female person, is exposed to public view or is not covered by an opaque covering.

This section shall not apply to:

(a) Children under the age of five (5) years; and,

(b) Live theatrical performances performed in a theater, concert hall, or other similar establishment located on public land; and,

(c) The interior of any public restrooms or clothes changing facilities.

4018 - Tampering with lighting system.

It shall be unlawful for any person to break, destroy or otherwise tamper with any electric light poles, globes, lights or other material belonging or connected with the electric lighting system of any public facility.

4019 - Prohibited acts designated.

Except as specified and conditioned by Resolution of the Council, it shall be unlawful for any person within the limits or upon any portion of the public facilities or buildings of the City to commit any of the following acts:

(a) Cutting, breaking, injuring, defacing or disturbing any tree, shrub, plant, rock, building, monument, fence, bench or other structure, apparatus, or property, or making or writing upon any building, monument, fence bench or other structure.

(b) Cutting or removing any wood, turf, grass, soil, rock, sand or gravel.

(c) Distributing any handbills or circulars, or posting, placing or erecting any bills, notices, papers, or advertising device or matter of any kind.

(d) Hitching or fastening any horse or other animal, except at a place especially designated for such purpose.

(e) Riding or driving any horse or other animal or propelling any vehicle, cycle or automobile elsewhere than on the roads or drives provided for such purpose.

(f) Indulging in riotous, boisterous, threatening or profane and indecent language.

(g) Practicing, carrying on, conducting or soliciting for any trade, occupation, business or profession.

(h) Permitting or allowing any livestock to run at large within the boundaries of said public facilities and City buildings, including all such pets, animals and fowls.

(i) Operating of model airplanes powered by internal combustion motors between the hours of 8:00 p.m. of one day and 10:00 a.m. of the following day. Such operation is also prohibited in any place on the public facilities or City buildings or at any other place therein where it creates or may create a physical hazard to the then users of the public facilities or City buildings.

(j) The entering of any male person over eight years of age into any restroom for women.

(k) Stabling, keeping, pasturing any horse, stud, stallion, mare, gelding, colt, jack, jenny, mule, cow, bull, steer, calf, oxen, sow, boar, pig, shoat, ram, sheep, lamb, goat, kid or other animal or animals.

(l) Discharging any firearms, firecrackers, rockets, torpedoes, or other fireworks or air guns or slingshots.

(m) Park any vehicle in other than a designated parking space within the time and hours posted for such parking.

(n) Abandon or store an inoperative vehicle, of any type, at any time.

(o) Any person driving a vehicle within the limits of the public facilities or City buildings shall drive the same at a careful and prudent speed not greater than is reasonable and proper, having due regard for the traffic, surface and width of the roads, and in no event shall a person drive any vehicle within the limits thereof at a speed greater than the posted limits, and if not posted, 15 MPH.

(p) Use of bows and arrows, or pointed darts except in a program specifically sponsored by the Department of Recreation and Community Services.

(q) Hitting of golf balls except in a program specifically sponsored by the Department of Recreation and Community Services.

(r) Playing baseball with a hardball except in areas designated for such purposes or in a program specifically sponsored by the Department of Recreation and Community Services. For the purposes of this section, a hardball shall be defined as a ball similar to or as used in professional baseball as conducted by major league baseball teams.
