Sec. 4-2.301. - Fire hazard defined.¶
For the purposes of this article, "fire hazard" shall mean any forested or brush-covered land or area upon which there is dry grass or other inflammable material; provided, however, this definition shall not be construed as including any permanently occupied building.

Sec. 4-2.302. - Prohibited acts.¶
Between June 1 and November 1 of each year it shall be unlawful for any person to smoke or to have in his possession any lighted, flaming, or glowing portion of any substance or thing used in the practice or habit of smoking along any trail or upon any spot or area within any timber or timbered or brush-covered area where fire hazard conditions exist, except as otherwise provided in Section 4-2.303 of this article.

Sec. 4-2.303. - Permitted.¶
Notwithstanding the provisions of Section 4-2.302 of this article, smoking shall be permitted as follows:
(a) In improved campgrounds;
(b) Inside vehicles on roads;
(c) At places of habitation; and
(d) While stopped in a cleared or barren area ten (10') feet in diameter.
In all instances of smoking, burning or glowing substances shall be completely extinguished before being discarded.

Sec. 4-2.304. - Enforcement.¶
The provisions of this article shall be enforced by all County, State, and Federal peace officers, the Forest Service Officer, the Fire Warden, and the Fish and Game Warden.
