5-4-1: PERMIT AND LICENSE REQUIRED:¶
Every person who operates the business of selling or peddling tickets, checks or coupons to be used in payment or part payment for picture frames, pictures, portraits, photographs, or the enlarging or retouching of the same or who engages in the taking of photographs and every person engaged in the business of selling, offering for sale, or taking orders for or soliciting the sale of any goods, wares, merchandise, or other personal property the subject of sale or trade, whether for present or future delivery, on any street, public place, or vacant lot, or by a house to house canvass or by traveling from place to place in the city, including sales by sample and also including the taking or soliciting of orders for future delivery of photographs, portraits, prints, pictures, newspapers, magazines, clothing, fixtures, machines, appliances, and all other articles or things to be made, produced, combined or manufactured, and every person employed by such person to solicit business shall first secure a permit from the chief of police and a license from the tax collector. 5-4-2: APPLICATION FOR PERMIT:¶
Every person requiring a permit as provided for herein shall make written application to the chief of police for the permit on forms provided by the police department. The application shall be accompanied by fingerprints of the applicant, shall contain all information deemed relevant by the chief of police and shall contain in addition thereto the name, business or occupation and resident address of each person financially interested in the business. Permits requested by persons acting as solicitors for the person conducting, carrying on or managing the business shall be first authorized, in writing, by the person engaging, employing or hiring the person. "Solicitors" shall mean every person acting as servant, agent or employee of the person conducting, carrying on or managing the business. (Ord. 768, 5-19-1955)
5-4-3: INVESTIGATION; ISSUANCE OR DENIAL OF PERMIT:¶
Upon receipt of the application, the chief of police shall conduct such investigation as he may deem proper as to the character and morals of the applicant and the character of the business to be conducted. No permit shall be issued to any person who has been convicted of a felony, petty theft or a crime involving moral turpitude. (Ord. 768, 5-19-1955)
5-4-4: PERMIT FORWARDED TO TAX COLLECTOR:¶
When any permit is issued under the provisions of this chapter, the chief of police shall cause the permit to be forwarded to the office of the tax collector for delivery to the permittee upon the payment of the license fee as prescribed by chapter 1 of this title. The permit shall be carried by the permittee at all times and exhibited upon request. (Ord. 768, 5-19-1955)
5-4-5: REVOCATION OF PERMIT:¶
The chief of police may revoke any permit issued hereunder when the permittee is violating or attempting to violate any law of the state or the city. (Ord. 768, 5-19-1955)
5-4-6: LICENSEE; COMPLIANCE WITH REGULATIONS:¶
The issuance of a permit or license under the provisions of this chapter shall not exempt the permittee from any other provisions of this code requiring a permit or license or otherwise regulating the business defined herein. (Ord. 768, 5-19-1955)
5-4-7: INVESTIGATION FEE:¶
At the time of filing with the chief of police the application for a license, the applicant shall pay a fee as set by resolution of the city council. (Ord. 1300, 5-25-1982)
5-4-8: APPEAL:¶
Any person aggrieved by the action of the chief of police or by the tax collector in the denial of a license shall have the right to appeal to the council. The appeal shall be taken by filing with the council, within fourteen (14) days after notice of the denial, a written statement setting forth fully the grounds of appeal. The council shall set a time and place for a hearing on the appeal and notice of the hearing shall be given to the appellant by mailing a notice, postage prepaid, to the appellant at his last known address at least five (5) days prior to the date set for hearing. The decision and order of the council on the appeal shall be final and conclusive. (Ord. 768, 5-19-1955)
5-4-9: EXCEPTIONS TO CHAPTER:¶
This chapter shall not apply to those who are classified and are paying a city license as either a resident merchant or a nonresident merchant, nor to the employees, of a resident or nonresident merchant. (Ord. 768, 5-19-1955)
