8-14-1: DEFINITIONS:¶
ALCOHOLIC BEVERAGE: Any alcohol, spirits, liquor, wine, beer, and every liquid or solid containing alcohol, spirits, wine or beer and which contains more than one-half of one percent (0.5%) of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed or combined with other substances. 8-14-2: ALCOHOLIC BEVERAGES:¶
No person, whether in any vehicle or not, shall possess or consume any alcoholic beverage in or upon any public street, alley, sidewalk, parkway, off street parking area or park except as provided in subsection 8-11-1(E) of this title. (Ord. 1375, 8-13-1985; amd. Ord. 1657, 9-10-2013)
8-14-3: EXCEPTIONS:¶
(A) The consumption and/or possession of alcoholic beverages as defined herein may be permitted at special events where the sponsor has obtained a temporary license for the sale of alcoholic beverages from the department of alcoholic beverage control or by permit of the city council or its designee. For purposes of this section, the city council does hereby designate the following persons to act as its agent: city administrator, chief of police and director of parks and recreation. 8-14-4: PENALTIES:¶
Any person violating any provisions of this chapter is guilty of an infraction and upon conviction thereof is punishable as set forth in section 1-4-5 of this code. (Ord. 1357, 6-26-1984)
