8-8-1: DEFINITION:

For the purpose of this chapter, the words "public property" shall mean any publicly owned property within the city, except the traveled portion of public streets, and shall include any park, sidewalk, curb, or any part of any public right of way devoted to any planting. (Ord. 997, 8-11-1970)

8-8-2: UNLAWFUL ACTS:

It shall be unlawful for any person to perform or participate in any of the following acts:

(A) Acts Involving Buildings And Other Property:

  1. To wilfully mark, deface, disfigure, injure, tamper with, displace, or remove any railing, bench, or any facilities or property and equipment of any public utility or parts or appurtenances thereof, signs, notices, or placards, whether temporary or permanent, monuments, stakes, posts, or other boundary markers, wall or rock border, or other structures or equipment, facilities or public property or appurtenances whatever, either real or personal.

  2. Construct or erect any building or structure of whatever kind, whether permanent or temporary in character, any tent, fly or windbreak, or run or string any rope, cord, or wire into, upon, or across any public property, except on special permit issued pursuant to a city ordinance, resolution, or regulation.

  3. Urinate or defecate, except in a public restroom.

(B) Acts Involving Trees, Shrubbery, And Plants:

  1. Without a city permit, to damage, cut, carve, burn, transplant or remove any tree or plant or injure the bark or pick the flowers or seeds of any tree or plant. Nor shall any person attach any rope, wire, or other contrivance to any tree or plant. No person shall dig in or otherwise disturb, or in any other way injure or impair the natural beauty or usefulness of any park area.

  2. Climb any tree, or walk, stand or sit upon monuments, vases, fountains, railings, fences, planted areas, or upon any other property not designed or customarily used for such purposes, or to sit on any sidewalks or steps, or to lie or sit on any lawns which are posted with a sign prohibiting this use on the lawn area.

(C) Litter Regulations:

  1. It shall be unlawful for any person to dump or deposit upon any highway, freeway, alley, street, off street parking lot, whether it be public or privately owned, park, playground, or any public place in the city, any glass, bottle, nails, tacks, hoops, wire, cans, or any other substance likely to injure any person, animal, or vehicle.

  2. It shall be unlawful for any person to place, deposit, or dump any garbage, swill, cans, bottles, papers, ashes, refuse, the carcass of any dead animal, offal, trash, or rubbish, or any noisome, nauseous or offensive matter in or upon any highway, freeway, alley, street, off street parking lot, park, playground, or any public place in the city. 8-8-3: SLEEPING ON PUBLIC PROPERTY:

It shall be unlawful for any person to sleep on any public sidewalks, curbs, planters, walls, or to engage in any loud, boisterous, threatening, abusive, insulting, or indecent language; or to block pedestrian traffic on the sidewalk or other public walks, ways, or footpaths devoted to pedestrian use; or to engage in any disorderly conduct or behavior. 8-8-4: LICENSE TO SELL:

It shall be unlawful to expose or offer for sale any article or thing, or station or place any stand, cart or vehicle for the transportation, sale, or display of any such article or thing without first obtaining a license therefor. (Ord. 997, 8-11-1970)

8-8-5: ADVERTISING IN PUBLIC PARK:

While in a public park it shall be unlawful to announce, advertise, or call the public attention in any way to any article or service for sale or hire. (Ord. 997, 8-11-1970)

8-8-6: POSTING OF SIGNS:

It shall be unlawful to paste, glue, tack, or otherwise post any sign, placard, advertisement, or inscription whatever, or to erect or cause to be erected any sign whatsoever on any public property, public land or highway or road unless a permit has first been obtained pursuant to an ordinance, resolution or other regulation of the city. 8-8-7: PROFANE LANGUAGE:

It shall be unlawful for any person within the city to utter or use within the hearing of one or more persons any profane or vulgar language, words, epithets, or expressions having a tendency to incite or create a breach of the peace. (Ord. 997, 8-11-1970)

8-8-9: OBSTRUCTING ENTRANCES PROHIBITED:

No person shall block, impede or obstruct any public place or any entrance, exit, or approach to any place of business in or upon any public place in a manner calculated or with the intent to prevent, delay, hinder, or interfere with the free passage therealong or therethrough of any person who is entering, occupying, or leaving any such place of business, or who is performing any services or labor, or who is seeking or obtaining employment, or who is purchasing, selling, using, delivering, transporting or receiving any goods, wares, merchandise, services, entertainment, accommodations or articles, or who is attempting or seeking to do any of the foregoing, or to prevent, delay, hinder or interfere with the free passage therealong or therethrough of any vehicle or conveyance operated by or in the custody of any such other person or in which any such other person is riding or attempting to ride. 8-8-10: PENALTY:

Violation of section 8-8-9 of this chapter shall be a misdemeanor with penalties as set forth in section 1-4-5 of this code. (Ord. 1356)

8-8-11: CITY CEMETERY REGULATIONS:

(A) City cemeteries, specifically Old City cemetery and Uppertown cemetery, shall be closed at dusk unless special permission has been given by the director of public services of the city to have a cemetery remain open after dusk for some special reason.

It shall be unlawful for any person to be present on the premises of any city cemetery after the same has been closed as set forth herein.

(B) No person shall possess or consume any alcoholic beverage in or upon city cemetery property. (Ord. 1569, 12-12-2000)
