§ 13.24.010. Definitions.

Unless the context requires otherwise, the definitions set forth in this section govern the construction of this article. All other terms shall be taken in their normal meaning.

"Permit"

means a license issued by the Placer County health officer to any septage hauler to engage in removing septage from septage holding or solids removal facilities.

"Septage"

means materials accumulated in septic tanks, cesspools, vault toilets, chemical toilets, recreation vehicles, and other sewage holding or sewage solids separation facilities which receive wastewater from plumbing fixtures and/or human body wastes. Septage does not include sewage sludge from municipal or community sewage treatment plants.

"Septage hauler"

means a person, firm, association, or corporation engaged in the business of removing septage from septage holding or solids separation facilities, and disposing of septage.

"Septage receiving facilities"

means structures, earthworks, tanks, or other facilities approved by the Placer County health officer and constructed specifically for the purpose of receiving septage and/or disposing of septage.

"Vehicle"

means a tank truck used to remove septage from its container.

§ 13.24.020. Permit required.

Any septage hauler engaged in the business of transporting and disposing of septage collected within Placer County, shall be required to first obtain a permit from the Placer County health department, environmental health division. A permit will be required from all septage haulers, regardless of where they dispose of the septage.

§ 13.24.030. Expiration of permit.

Each permit issued pursuant to this article shall be valid for the remainder of the calendar year in which issued.

§ 13.24.040. Fees.

The fee for each permit issued pursuant to this article shall be as set forth in Section 2.116.110 or any portion thereof for septage haulers. The fee shall be paid in a lump sum upon application of the permit.

§ 13.24.050. Conditions of issuance.

A. Each permit issued pursuant to this article shall be revocable by the Placer County director of environmental health for cause and shall not be transferable from person to person.

B. No permit shall be issued unless all provisions of this article are complied with.

§ 13.24.060. Requirements of vehicles.

Each vehicle shall comply with the following:

A. The name and address of the septage hauler shall appear on each side or the rear of the tank or vehicle in minimum four-inch high letters, and shall be legible.

B. The permit number shall appear on each side or the rear of the tank or vehicle in minimum four-inch high numerals, and shall be legible.

C. The discharge pipe shall be provided with a leak-proof cap which is chained to the vehicle to prevent its loss.

D. The tank and vehicle shall be kept clean and in good repair, and the tank and appurtenances shall be free of leaks.

§ 13.24.070. Reporting requirements.

Each septage hauler shall submit to the division of environmental health monthly reports certifying the date, name of owner and address of each premises where septage has been removed by said hauler and the exact location at which the septage from said premises was disposed of. Said reports shall be submitted on forms provided by the director of environmental health.

§ 13.24.080. Disposal of septage.

A. Each permit holder shall dispose of all septage at an approved and permitted septage disposal site.

B. It is unlawful to place, deposit, or dispose of septage which has been removed from its container anywhere in the county except by permit issued under these provisions and at such site or at an authorized site in another county.

§ 13.24.090. Violations.

Violation of any provision of this article shall be punishable as provided for in Article 1.24 of the Placer County Code.

§ 13.24.100. Citation powers.

The health officer, director of environmental health and their duly authorized representatives in the division of environmental health are empowered to issue a citation for the first violation of any provision of this article.

§ 13.24.110. Review of permit fee.

The permit fee set forth in Section 13.24.040 of this article is primarily intended to defray the cost of the annual permit, record maintenance, and vehicle inspection.
