9.36.010 - Declaration of purpose.

The city council of El Paso de Robles hereby finds, determines and declares that there are maintained within the city limits of said city certain devices described in Section 330b(4) of the Penal Code of the State of California, which are capable of and are being used for gambling purposes. The city council further finds, determines and declares that the presence and use of such machines for gambling purposes foster delinquency in minors; that the presence of such machines in the city is contrary to the health, safety, morals and general welfare of the people of this city.

9.36.020 - Maintaining machines illegal.

It shall be unlawful for any person. firm or corporation to keep, maintain, possess or have under control in any place whatever, either as owner, lessee, agent, employee, mortgagee or otherwise, any table game or device commonly known as a "pinball machine," "pin game" or "marble game" or similar device by whatever name known, the operation, use or play of which is controlled by placing therein any coin, plate, disk, plug, key or other device, or by the payment of any fee, provided that possession of such devices for the sole purpose of storage or repair on premises other than retail licensed premises shall not be unlawful if such machines are rendered inoperative while within the city.

9.36.030 - Machines declared nuisance.

Any machine, contrivance, appliance, device, game, instrument or article kept, maintained, possessed or controlled in violation of Section 9.32.020 is declared to be a nuisance and shall be subject to abatement.

9.36.040 - Penalties for violation.

Any person, firm or corporation violating any of the provisions of this chapter is guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed five hundred dollars or by imprisonment in the city jail or the county jail for not to exceed six months, or by both such fine and imprisonment.
