9.48.010 - Short title.

This chapter shall be known as the "fire hydrant ordinance."

9.48.020 - Definitions.

The following terms used herein are defined as follows:

A. "Chief" means the chief of the fire department.

B. "City" means the city of Pasadena.

C. "General manager" means the administrative head of the water department.

D. "Person" means an individual, firm, partnership, association, corporation or governmental entity other than the city.

9.48.030 - Connection permit required.

A. Application. Any person intending to take water through, from or by means of any fire hydrant shall apply in writing to the chief or the general manager showing the location of the hydrant and the times at which he intends to take water or use the hydrant. The application shall include other information required by the general manager and the chief.

B. Denial of Permit. The chief may deny a permit when:

  1. The issuance would interfere with the proper conduct of the fire department and the prevention of fires; or

  2. The applicant has damaged or injured any fire hydrant, or part thereof, and has not restored the same to the satisfaction of the chief; or

  3. The applicant is indebted to the city for water, or whose use of water through hydrants is deemed by the general manager to be against public interest.

C. Deposit and Permit Fee. No permit shall be issued by the chief or the general manager until a deposit has been made for the permit and a permit fee has been paid for each hydrant included in the permit for each month or portion thereof during which such hydrant will be used. The deposit and permit fee will be in amounts set forth in the water rate ordinance.

D. Refund of Deposit. The deposit may be refunded when the chief or the general manager finds the hydrants covered by the permit have not been damaged.

9.48.040 - Taking water without permit.

No person shall take water through, from or by means of or use any fire hydrant without a fire hydrant connection permit or take water through, from or by means of or use any fire hydrant at any time other than that for which a permit is issued, or in violation of the terms and conditions fixed therein.

9.48.050 - Hydrant operations.

Any person taking water through, from or by means of or using any fire hydrant shall, at the end of each day, gradually close the valve upon the hydrant so the hydrant shall be in good working order, disconnect attachments of every kind from the hydrant, and shall carefully replace all caps on the hydrant. He shall also provide himself with a fire department approved spanner which fits the valve stem and cap accurately. No person shall apply to or use upon the valve stem or cap of any hydrant a wrench which does not fit the valve stem or cap to which it is applied.

9.48.060 - Liability for damages.

No person shall injure or damage any fire hydrant in the city. Any person injuring or damaging a hydrant shall be liable for the cost of repair or replacement as determined by the chief.

9.48.070 - Obstructing hydrants.

No person shall deposit or permit to remain any dirt, refuse or other obstruction on any public street or alley within 20 feet of any city fire hydrant. Except, when street improvements or excavations are being made by the city, utility companies, or others pursuant to a permit issued by city, such obstructions shall be permitted so long as access to hydrants and gate valves is kept unobstructed at all times during such improvement work.

9.48.080 - Violation—Misdemeanor.

Any person violating any provision of this chapter is guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not to exceed $500.00, or by imprisonment in the city jail for not to exceed 6 months, or by both such fine and imprisonment.
