Chapter 3.20 — PARADE PERMITS

3.20.010 - Required.¶
It is unlawful for any person, firm, association or corporation to hold, manage, conduct, carry on, participate in, or to cause to be held, managed, conducted or carried on any parade, march or procession of any kind or any other similar activity or to beat or play any drum, triangle, tambourine or any wind or string instrument upon any public street or alley in the city without first having applied for and obtained a permit therefor from the city manager as provided herein.

3.20.015 - Reimbursement of costs required.¶
The city manager shall require as a condition to the issuance of any permit authorized hereunder that the applicant shall reimburse the city for any and all costs incurred by the city in providing services which are appropriate and necessary for the maintenance of public order during the parade sponsored by the applicant. The city manager is authorized to waive a portion or all of the aforementioned costs incurred by the city in the course of the annual Tournament of Roses Parade or any other parade held between December 25th of each year and January 7th of the subsequent year.

3.20.020 - Application—Contents.¶
Any person, firm, association or corporation desiring to do any of the acts specified in Section 3.20.010 shall file an application with the city manager upon a form to be supplied by the city without charge to the applicant setting forth the following information in regard to the proposed event:
A.
The name and address of the applicant;
B.
The purpose;
C.
The date and time;
D.
The place and/or route.

3.20.030 - Application—Investigation—Action.¶
A.
All applications filed pursuant to this chapter shall be acted upon by the city manager within a reasonable time from the date of filing.
B.
Should the city manager after an investigation of the applicant and the facts contained in the application determine that the applicant has stated true facts in his application and that the event as proposed will not interfere unduly with the use of the streets and will not tend to cause a breach of the public peace, he shall issue a permit designating the time, place and route of the event.

3.20.040 - Application—Denial—Appeal.¶
A.
Any person, firm, association or corporation aggrieved by any ruling of the city manager upon any application filed pursuant to the provisions of Sections 3.20.010 through 3.20.030 may file with the city clerk a statement, addressed to the board of directors of the city, setting forth the contents of the application filed with the city manager, the action taken thereon by the city manager and the reasons why it is believed the city manager acted improperly.
B.
The board of directors of the city at its next regular meeting held after the date on which the appeal is filed with the city clerk, shall hear the appeal and the determination of the board of directors thereon shall be final.

3.20.050 - Penalty for violation of Sections 3.20.010 through 3.20.040.¶
Any person, firm, association or corporation violating any of the provisions of Sections 3.20.010 through 3.20.040 is guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine not to exceed $500.00 or by imprisonment in the city jail for a term not to exceed 6 months, or by both such fine and imprisonment.

3.20.060 - Required for crossing curb to park.¶
It is unlawful for any person owning or in possession or control of, or who is agent for, or represents the owner of or agent for, any premises along the route of any street parade in the city to demand or receive any fee or charge for the use of space for standing any automobile or other vehicle on such premises on the occasion of such parade, unless the amount of the fee or charge to be exacted for such space is conspicuously posted upon the premises before the owner or person in charge of such automobile or vehicle is permitted to occupy the space. Any such person, before permitting such use of premises that are not provided with a driveway connecting the same with the street, shall first obtain from the superintendent of streets a permit for crossing the curb and parking. It is unlawful for any person so renting space on any such premises, whether provided with a driveway or not, to fail to properly protect the curb and parking from damage caused by crossing the same.

3.20.070 - Penalty for violation of Section 3.20.060.¶
Any person who violates any of the provisions of Section 3.20.060 is guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding $100.00, or by imprisonment in the city jail for a period not to exceed 30 days, or by both such fine and imprisonment.
