Chapter 9.20 — GAMING AND GAMBLING

9.20.010 - Gaming and gambling prohibited.

Every person who deals, plays, carries on, opens or causes to be opened, or who conducts either as a player, owner or employee, whether for hire or not, any gaming and gambling, as that term is defined in Section 9.20.020, for money, checks, credit or other representative of value, in any public place or place open to the public, is guilty of a misdemeanor.

9.20.020 - Gaming and gambling defined.

The term "gaming and gambling" shall mean any game of chance or skill played with cards, dice or any device which has the purpose of substituting for cards or dice, including any computer simulation thereof, which is neither expressly permitted nor prohibited by state law.

9.20.030 - Public place or place open to the public defined.

The terms "public place or place open to the public" as used in this chapter shall not include any of the following:

A.

Residences and residential property, whether individual or group, nor any common area or recreation facility appurtenant to such residence, used with the consent of the owner or person with managing authority over such residence or common areas.

B.

Facilities owned, leased or rented by any nonprofit corporation or charitable organization, duly registered as such with the Internal Revenue Service, the state of California or the county of Los Angeles, for the purpose of raising funds for such corporation or organization.

9.20.040 - Violation—Penalty.

Any person violating any provision of this chapter is deemed guilty of a misdemeanor, and on conviction thereof shall be punishable by a fine of not more than $500, or by imprisonment not to exceed six months, or by both such fine and imprisonment.
