15.16.001 - County provisions adopted.

Chapter 15.16 of the Fresno County Code is adopted in its entirety by reference pursuant to California Government Code Section 50022.9 and is enacted and incorporated in this chapter.

15.16.011 - County Section 15.16.010 amended—Definitions.

A. The following language is added as a separate paragraph to the end of the definitions of "substantial improvement" in adopted Fresno County Code Section 15.16.010:

This term does not include any project for improvement of a structure to comply with existing state or local health, sanitary, or safety code specifications which are solely necessary to assure safe living conditions.

B. The following term and its definition is added to adopted Fresno County Code Section 15.16.010:

"Variance" means a grant of relief from the requirements of this chapter which permits construction in a manner that would otherwise be prohibited by this chapter.

15.16.070 - Variance procedure.

Section 15.16.010 of the adopted Fresno County Code is amended to read as follows:

15.16.070 Variance procedure.

Any exceptions to the requirements of this chapter, including basements or other finished floors constructed below the one-hundred-year flood level, shall be approved only by variance. Variances shall not be granted for development within any designated floodway. Outside a designated floodway a variance can be granted by the City Council only upon a showing of severe hardship and gross inequity in the particular case involved, and that it will not adversely affect other properties or public safety or increase public costs. All such variances shall be recorded in connection with the particular property in the county recorder's office and records shall be maintained in readily accessible form by the building official.
