Chapter 6.15 — AEROSOL SPRAY PAINTS

6.15.010 - Purpose and intent.

It is the purpose and intent of this chapter to inhibit access to aerosol-propelled spray paints otherwise made available for sale within the city, by prohibiting the display and sale of such aerosol spray paint containers from a location without restricted access to the public.

The city finds and determines that the display of such aerosol containers in, and their sale from, displays to which the public have direct unrestricted access poses a danger to the health and safety of the city and its citizens. The city further finds and determines that reasonable limitations on access to such aerosol spray paint containers will help to deter the otherwise detrimental impact of graffiti on the city and its residents and aid in the prevention of the further spread of graffiti.

6.15.020 - Definitions.

Whenever the following terms are used in this chapter, they shall have the meaning established by this section:

"Aerosol spray paint" means any paint, dye, coloring, stain, or similar substance contained in a canister under pressure which is intended to be, and can be, propelled from the container by pressurized gases within the container.

"Aerosol spray paint container" means a container, made of any material, which contains aerosol spray paint, as defined.

"Restricted access" means that either physical or visual accessibility is limited by means of: (1) a transparent physical barrier between the aerosol spray paint containers and potential customers, (2) a storage location inaccessible to the view or reach of customers of a store or commercial establishment selling aerosol spray paints, or (3) procedures implemented by a retailer of aerosol spray paints which require intervention of a supervising or overseeing representative of the retailer during any time when a customer enjoys physical access to aerosol spray paint containers.

6.15.030 - Prohibitions relating to sale of aerosol spray paints.

Aerosol spray paint containers shall not be displayed for sale or sold except with restricted access as defined in Section 6.15.020.
