* Article 1 entitled "Reserve for Drainage Facilities Construction Funds", consisting of Sections 7-4.101 through 7-4.103, codified from Ordinance No. 478, as renumbered by Ordinance No. 408-C.S., effective July 11, 1984, amended in its entirety by Ordinance No. 458-86, effective March 26, 1986. Former Section 9-3.907 of this Article 3 of Title 9 of this Code renumbered and recodified as a part of Article 1 by said Ordinance No. 458-86.

Sec. 7-4.101. - Payment of fees: Schedule of fees required.

At the time of the filing of a final map or planned development, and for the purposes of defraying the actual or estimated cost of constructing planned drainage facilities for the removal of surface and storm drainage waters, a per acreage fee shall be paid to the Director of Finance for any portion of the subdivision which is contained within the areas defined on the "Pacifica Drainage Master Plan - Watersheds," set forth in this section as "Exhibit A," in accordance with the following schedule:

To provide for construction cost increases due to inflation, on July 1 of each year, beginning September 1, 1990, the fee shall be increased on the basis of the Construction Cost Index (CCI) in the San Francisco Bay Area, published in the issue of the Engineering News Record (ENR) by McGraw-Hill Publishing Company.

Sec. 7-4.102. - Establishment.

A separate fund shall be established in the City treasury for each local drainage area, such funds to be known as Reserve for Drainage Facility Construction Funds.

Sec. 7-4.103. - Deposits.

The fees required for planned drainage facilities by the provisions of Section 7-4.101 of this article shall be deposited into a Reserve for Drainage Facility Construction Fund. In the discretion of the Council, cash or other consideration may be accepted in lieu of the payment of fees.

Sec. 7-4.104. - Expenditures.

The funds derived from the fees required by the provisions of this article and the moneys in said Reserve Funds shall be utilized solely for the purposes of defraying the actual or estimated costs of construction or reimbursement for the construction of planned local drainage facilities for the removal of surface and storm waters within the planned local drainage area from which the fees comprising the fund were collected.

Sec. 7-4.105. - Master Plan for Storm Drainage: Construction of facilities described.

The Master Plan for Storm Drainage, prepared by Charles S. McCandless & Company, dated April, 1961, as amended by the City Engineer, dated December 1, 1964, adopted by the Council by Resolution No. 708 on February 10, 1965, pursuant to the provisions of Section 65469 of the Government Code of the State, contains an estimate of the total cost of constructing the local drainage facilities required by said Plan. The Council hereby finds and determines that the subdivision and development of property within the planned local drain-age areas will require the construction of the facilities described in the Master Plan for Storm Drainage and that the fees required by the provisions of this article are fairly apportioned within the local drainage area, both on the basis of benefits conferred on property proposed for subdivisions, and on the need for local drainage facilities created by the proposed subdivision and development of other property within the local drainage area.

Sec. 7-4.106. - Construction of facilities: Advance of funds.

The City may advance money from its General Fund to pay the cost of constructing drainage facilities within a local drainage area and may reimburse the General Fund for such advances from the Reserve for Drainage Facility Construction Fund for the local drainage area in which the drainage facilities were constructed.

Sec. 7-4.107. - Construction of facilities: Incurring of indebtedness.

The City may incur an indebtedness for the construction of drainage facilities within a local drainage area; provided, however, the sole security for the repayment of such indebtedness shall be moneys in the Reserve for Drainage Facility Construction Funds.
