Pacifica Municipal Code Ch. 7 Prequalification of Bidders on Public Works Projects

Sec. 7-7.100. - Prequalification.

(a) The City's Director of Public Works is hereby authorized to implement a contractor prequalification procedure for prospective bidders on the City's public works construction projects. Bidders may be prequalified for all City projects of a specified type and size, or for an individual project.

(b) The procedure shall require that prospective bidders complete and submit standardized questionnaires and financial statements. The Director of Public Works may elect to utilize all or portions of the prequalification documents prepared by the State of California, Department of Industrial Relations, and may utilize different prequalification materials for different projects. All prospective bidders for a particular project shall be evaluated based on the same prequalification materials. The Department of Public Works shall apply a uniform system of rating bidders on the basis of the questionnaires and financial statements.

(c) The prequalification materials shall include, but need not to limited to, the following:

(i) The prospective bidder's experience with public works projects and projects of a similar size and complexity;

(ii) The prospective bidder's personnel, equipment, materials and other facilities or resources to perform the work;

(iii) The prospective bidder's ability to provide the required bonds and insurance;

(iv) The prospective bidder's financial ability/condition;

(v) The prospective bidder's safety record and record of compliance with prevailing wage and other laws applicable to public works projects; and

(vi) Such other information as may be appropriate for a particular project.

Sec. 7-7.101. - Appeals.

Any prequalification procedure will include a process that will allow prospective bidders to dispute their proposed prequalification rating prior to the closing time for receipt of bids. The appeal process shall comply with the requirements of Public Contract Code Section 20101(d).

Sec. 7-7.102. - Individual projects.

The Public Works Director is hereby authorized to tailor the contractor prequalification and appeal procedures, prequalification questionnaire and evaluation criteria for each project individually.
