Article 4 — Departments

* Article 4 entitled "Department of Finance", consisting of Sections 2-4.401 through 2-4.406, codified from Ordinance No. 407, repealed by Ordinance No. 340-C.S., effective July 28, 1982.

The City Manager, upon the approval of the Council, shall designate and organize the City staff and its service functions and activities into departments and other related organizational units to provide for the efficient and effective operation and management of the City. All department directors, subject to the approval of the City Manager, shall designate an acting director who shall perform the duties and exercise the powers of the director in his absence or disability. The specific functions and duties of each designated City department shall be set forth by the City Manager upon the review and approval of the Council.

The established departments of the City are as follows:

(a)

Department of Finance and Central Services;

(b)

Department of Police Services;

(c)

Department of Fire Services;

(d)

Department of Community Development and Services; and

(e)

Department of Parks, Beaches, and Recreation;

(f)

Department of Public Works.

In addition to all other duties vested in the Director of Finance, he shall have the duties and obligations assigned to the office of City Treasurer as set forth in the general laws of the State. The Director of Finance shall be the City Treasurer and, as such officer, shall have the authority to execute, on behalf of the City, any and all documents and instruments required to be executed by him as City Treasurer.

The Fire Chief, or his successor in command, shall have supreme authority over the territory and persons involved in any fire, explosion, building collapse, or other emergency or threatened emergency to which the Fire Department would normally respond, except as provided by State laws and in disasters involving the civil defense organization. The Fire Chief shall have the authority and responsibility to do, or cause to be done, everything he determines necessary for the confinement and control of the situation to the end that maximum protection shall be afforded to life and property. During the existence of such emergency, the authority of the Fire Chief shall include the control of the water system in accordance with an agreement with the North Coast County Water District, the demolition of buildings, or parts of buildings, involved or in the path of involvement, and the use of such other City employees in such manner as he sees fit to control the situation and restore the Fire Department to a satisfactory state of operational readiness.

During an emergency, as set forth in Section 2-4.403 of this article, the Fire Chief shall have the authority to employ such persons, in addition to fire-fighting personnel, as may be necessary to control such emergency within the following general limits:

(a)

That all available sources of trained manpower available to the City under the Mutual Aid Agreement have been exhausted or are unavailable in time to be effective; and

(b)

That the acceptance of the services of civilians in actual fire-fighting work shall be prohibited, but that such civilians may be assigned such work under competent supervision as will not take them to situations of danger to themselves or to other persons working on the incident.

A finding of necessity for such employment by the Fire Chief, or his successor, shall be conclusive evidence thereof.

Pursuant to the provisions of the laws of the State, the City Health Department is consolidated with the County Health Department for the purpose of enforcing State laws and City regulations and laws relating to public health.
