Article 2 — Capital Projects Fund

Sec. 7-4.201. - Purpose.¶
New structures built in the City make additional capital outlays necessary by creating demands for additional municipal services and facilities, while benefiting from existing services and capital improvements. Therefor, in order to develop capital programs and to provide for the capital outlays necessary to provide added services and facilities as a result of such new construction, and to safeguard life, limb, and the public health and safety, it is necessary to adopt the capital improvement fee schedule set forth in Section 7-4.202 of this article.

Sec. 7-4.202. - Fee schedule.¶
A capital improvement fee, in addition to the building permit fee, for each separate building permit issued for new construction shall be paid to the Building Official as follows:
(a)
For each finished or unfinished bedroom in each new dwelling unit, One Hundred Ten and no/100ths ($110.00) Dollars;
(b)
For each hotel or motel unit, Fifty-Five and no/100ths ($55.00) Dollars; and
(c)
For each other new structure, an amount equal to one percent of the permit valuation.
Exception 1. No capital improvement fee shall be charged for an accessory building.
Exception 2. No capital improvement fee shall be charged for buildings or structures whose primary uses are for Boy's Clubs, Girl's Clubs, Boy Scouts, Girl Scouts, or such other nonprofit activity as the Council
may waive the fee by permit.
To provide for construction cost increases due to inflation, on July 1 of each year, beginning July 1, 1985, the fee shall be increased on the basis of the Construction Cost Index (CCI) in the San Francisco Bay Area, published in the issue of the Engineering News-Record (ENR) by McGraw-Hill Publication Company.

Sec. 7-4.203. - Definitions.¶
For the purposes of this article, unless otherwise apparent from the context, certain words and phrases used in this article are defined as follows:
(a)
"Accessory building" shall mean a subordinate building the use of which is incidental to that of a single- family dwelling or a duplex family dwelling on the same lot and/or building site.
(b)
"Capital improvement" shall mean any improvement requiring an expenditure which is nonrecurring and of enduring value, which may include a city hall and civic center, teen-age center, recreational facilities, neighborhood parks, fire stations, and police and public works facilities, each with the necessary original equipment.
(c)
"Capital program" shall mean a plan for capital expenditures to be incurred each year over a fixed period of years to meet capital needs arising from the long-term work program. Such plan shall set forth each project and specify the full resources estimated to be available to finance the projected expenditures.
(d)
"Dwelling unit" shall mean one or more habitable rooms in a single- or multiple-family structure, which rooms are occupied, or which are intended or designed to be occupied, which facilities for living purposes.
(e)
"Hotel or motel unit" shall mean any portion of a building which is designed, built, rented, leased, let, or hired out to be occupied.

Sec. 7-4.204. - Created: Deposits: Disbursements.¶
The capital improvement fees paid in accordance with the provisions of Section 7-4.202 of this article shall be placed in a special fund to be known as the Capital Projects Fund. Disbursements from the Capital Projects Fund shall be made only in accordance with the capital improvement program adopted by the Council each year.
