13.20.010 - Violation of industrial wastewater system, sanitary sewer system or storm…

Any violation of the city industrial waste-water system operating rules; the sanitary sewer system operating rules; the storm drain system operating rules or any discharge requirement thereto, is guilty of a misdemeanor. Each day a violation occurs shall be deemed to be a separate offense. Each violation shall be punishable by a one-thousand-dollar ($1,000.00) fine and/or six months in jail.

13.20.020 - Violation of discharge requirements.

A. No person shall discharge in violation of any rule, regulation, statute or ordinance of the city council of the city, or state regulatory authority.

B. Any violation shall be considered as grounds for disconnection.

C. Any discharge in excess of ten thousand (10,000) EC count, shall be deemed and considered as a separate violation of this chapter and this code, and punished as such.

13.20.030 - Immediate disconnection when.

The city council finds that public safety, health and welfare, requires that immediate action be taken, should discharges of TDS have an electroconductivity equal to, or in excess of twenty thousand (20,000) micromhos centimeter; propose a significant danger to the residents of the city and put the city in violation of current regional water quality control board rules; and because, volumetrically, it is impractical to calculate and regulate discharges; therefore, any discharge having an EC count of twenty thousand (20,000) micromhos centimeter or greater, shall be cause for immediate disconnection and the city administrator is authorized to determine in his sole discretion any such violations and take such action as he deems appropriate.

13.20.040 - Reconnection of discontinued service.

Any reconnections of discontinued service by reason of a violation of this chapter or any other provision of this code, shall be allowed only upon providing of adequate assurances to the city administrator.
