§ 2.12.010. Definitions.

Except as otherwise indicated, the definitions contained in the Political Reform Act of 1974 (Government Code Section 81000), and regulations adopted pursuant thereto, as said Act and regulations now exist or hereafter may be amended, are incorporated into this conflict of interest chapter.

§ 2.12.020. Applicability.

This conflict of interest chapter shall be applicable to members of the City Council, whether acting as a Council Member or as Governing Board member or Commissioner of any City agency.

§ 2.12.030. Disclosure Requirement.

Pursuant to the requirements of Government Code Section 87200, as said Government Code now exists or hereafter may be amended, members of the City Council shall be required to disclose investments, interests in real property and income. No additional disclosure requirements shall be required by this conflict of interest chapter.

§ 2.12.040. Circumstances Requiring Disqualification.

Any member of the City Council, whether acting as a Council Member or as Governing Board member or Commissioner of any City agency, must disqualify himself or herself from making or participating in the making of any decision which will foreseeably have a material financial effect distinguishable from its effect on the public generally, on any economic interest, as defined in Government Code Section 87103, as said Government Code now exists or hereafter may be amended. No member shall be prevented from making or participating in the making of any decision to the extent his or her participation is legally required for the decision to be made.

§ 2.12.050. Violation—Penalty.

Except as otherwise provided in this chapter, a violation of any provision of this chapter shall constitute a misdemeanor as provided by Government Code Section 91000, as said Code now exists or hereafter may be amended, and shall be subject to such additional penalties as are specified in the Political Reform Act of 1974, as said Act now exists or hereafter may be amended (Government Code Section 81000 et seq.).
