Sec. 9-2-140. - Summary removal.

The Director shall immediately remove any encroachment which obstructs the flood control channel or interferes with the maintenance thereof.

Sec. 9-2-150. - Action for abatement of encroachment; penalty.

(a) Except as described in section 9-2-140, if the application for an encroachment permit is denied, and the owner or occupant of the encroachment, or the person causing or controlling the encroachment refuses to remove it, the Director shall commence, in a court of competent jurisdiction, an action in the name of the District to abate the encroachment as a nuisance.

(b) If the encroachment permit is denied, but an existing encroachment is not removed within five (5) days from and after service or posting of the notice described in section 9-2-120, the Director may remove the encroachment at the expense of the person causing or controlling the encroachment. The Director may recover from such owner, occupant or person, in an action brought in the name of the District for that purpose, the District's court costs and the expense of removal.

Sec. 9-2-160. - Enforcement as misdemeanor or infraction.

A violation of this ordinance may be prosecuted as an infraction or misdemeanor at the discretion of the Director. The complaint charging such violation shall specify whether the violation is a misdemeanor or an infraction.
