Article 2 — RECREATIONAL AREAS IN GENERAL

Sec. 2-5-15. - Hours.¶
All recreational areas shall be open to the public during such hours as may be established by the Director or his/her designee. No person, except those having valid County permits, shall enter or remain in any recreational area at any time other than during such hours as the recreational area is open to the public.

Sec. 2-5-16. - Fees.¶
All persons and groups using camping, parking or other special facilities of recreational areas shall, prior to such use, pay such fees and deposits as may be established by resolution of the Board of Supervisors.
Violations of this provision shall be punished by civil fine in an amount approved by the Board of Supervisors in the Orange County Uniform Traffic Bail Schedule.

Sec. 2-5-17. - Camping; encampments; occupancy of camp facilities; use of camp…¶
of personal property; payment of fees required.
(a)
As it relates to camping, camp facilities, and camp paraphernalia, as defined in this division, in designated areas:
(1)
It shall be unlawful for any person to camp, occupy camp facilities, use camp paraphernalia, or store personal property in a recreational area, except in an area designated for such purposes without paying
fees established for such purposes by resolution of the Board of Supervisors. Each adult seeking to use designated areas for such purposes will be required to present a current form of identification upon payment of fees.
(2)
No person shall camp, occupy camp facilities, use camp paraphernalia or store personal property in a recreational area in excess of the period prescribed by resolution of the Board of Supervisors.
(3)
In addition to the other penalties provided herein, violation of this section shall subject the violator to suspension of camping privileges, loss of prepaid fees and eviction from the recreational area.
(4)
Any property left in a recreational area after it closes, except personal property left in designated areas by persons having paid established fees thereof, shall be removed or impounded by the Director or his/her agents in accordance with the procedures set forth in Title 3, Division 21, Section 6.
(b)
If an unauthorized individual remains within any park, beach, or recreational area as defined in this division outside of the established operational hours, County officials or any agent acting on their behalf, or law enforcement, will advise the individual that they may move to any public area outside the park property. If the individual does not then leave the park property after receiving both a warning and a reasonable opportunity to gather his or her belongings, law enforcement may issue a citation or arrest the individual, as appropriate.

Sec. 2-5-18. - Electric outlets.¶
No person shall use electric outlets within any recreational area without first paying any such fees as may be prescribed by resolution of the Board of Supervisors.

Sec. 2-5-19. - Vending and commercial solicitation; permit required.¶
No person shall solicit primarily for commercial purposes in any manner, or sell or offer for sale any goods, wares, merchandise or food products, or distribute or pass out any primarily commercial handbill or advertising material without a written permit from the Director. Provided, however, that this section does not apply to any concession, license, or permit operated under direct or delegated authority granted by the Board of Supervisors, nor to any activity specifically exempted by order or resolution of said Board of Supervisors.

Sec. 2-5-20. - Eviction.¶
(a)
A person is subject to eviction from the park when the following conditions occur:
(1)
The person is in violation of a park rule or regulation;
(2)
The person has been warned in a manner that is reasonably calculated to reach that person that eviction may result from any further violation;
(3)
After receiving such warning, a further violation occurs;
(4)
No lesser sanction reasonably appears to suffice; or
(5)
Following a warning, the violation continues unabated regardless of the person's subsequent action.
However, where a violation is of such magnitude or seriousness of violence, no warnings will be necessary prior to eviction.
(b)
A group is subject to eviction from the park when any one of the following conditions occur and no lesser sanction reasonably appears to suffice:
(1)
There is probable cause to believe that an unlawful assembly exists pursuant to California Penal Code Section 407;
(2)
There is a clear and present danger of imminent violence or property damage which cannot reasonably be forestalled without evicting the entire group;
(3)
There exists a group sponsored or organized activity which violates one or more park rules and regulations and such group sponsored organized activity has not ceased as a result of one or more warnings given to the permit applicant and the group as a whole;
(4)
There are multiple individual violations of park rules and regulations which have not stopped following the eviction of one or more such individual violators and violations continue after the group has had a reasonable opportunity to cure them.
(c)
No person or group evicted from a park, beach or recreational area shall remain in or return to the facility prior to the expiration of the eviction period, a minimum of twenty-four (24) hours.

Sec. 2-5-25. - Special events: Permit required.¶
(a)
The Director shall designate the areas in each park or beach wherein special events may be held and shall determine the capacity limits for those areas. "Special Events" are organized public gatherings or activities, whether non-profit or for profit, or organized private gatherings or activities that exceed the capacity of the designated areas; private gatherings within the capacity of the designated areas shall not constitute "Special Events." No person shall cause a "Special Event" to occur in any park or beach without first obtaining an Orange County Parks Permit.
(b)
Orange County Parks Permits for "Special Events" may be subject to conditions to ensure that the permitted event does not interfere with other park or beach uses or activities and is conducted in a safe and orderly manner. Such conditions shall be limited to requirements that the permittee:
(1)
Provide security personnel to ensure that the event will be orderly and that attendees will comply with park or beach regulations;
(2)
Provide portable sanitary toilets/facilities in sufficient numbers to accommodate the expected number of attendees when attendance of more than five hundred (500) persons is expected;
(3)
Provide for clean up of litter and debris after the event;
(4)
Provide for control of the noise level of any sound amplification systems used so that applicable sound limits are not exceeded; and
(5)
Provide first aid personnel to ensure that the event will not unduly impact emergency services.
(c)
This section shall not apply to organized gatherings involving attendance of more than ten thousand (10,000) persons. The Board of Supervisors may, by resolution or minute order, adopt rules and regulations governing such events including, but not limited to, provisions for processing applications and limiting the number of such events.

Sec. 2-5-26. - Amplified sound system, music and live music—permit required.¶
No person shall set up, use, operate or maintain an amplified sound system, music and live music within any park, beach or recreational area except in those areas specifically designated, nor shall any person set up, use, operate or maintain an amplified sound system, music and live music without first obtaining a written permit. The Director, or his designated agents are expressly given the authority to determine the maximum amplification permissible in areas designated consistent with other persons' enjoyment of the recreational area facilities.

Sec. 2-5-27. - Protection of natural, cultural, structural, and archaeological resources.¶
(a)
Plants. No person shall possess, destroy, injure, deface, remove, dig, or disturb from its natural state any plant or the parts or products thereof in any park, beach or recreational facility, except as otherwise provided herein. No person shall attach or affix any handbill, notice, sign or advertisement on any plant or part thereof in or adjacent to a park or recreational facility.
(b)
Wildlife. No person shall possess, destroy, injure, deface, remove, dig, or disturb from its natural state any living or dead wildlife, or the parts or products thereof, such as antlers, shells, bones or nests, in any park, beach or recreational facility, except as otherwise provided herein. No person shall introduce any wildlife or plant, including their reproductive bodies, into any park, beach or recreational area ecosystem.
(c)
Artifacts. No person shall possess, destroy, injure, deface, remove, dig, or disturb from its natural state any fossilized or nonfossilized paleontological specimens, cultural or archaeological resources, or the parts thereof in any park, beach or recreational facility.
(d)
Minerals. No person shall possess, destroy, injure, deface, remove, dig, or disturb from its natural state any rock, mineral, geological formation or cave formation or the parts thereof in any park, beach or recreational facility.
(e)
Landscape Structures. No person shall walk on, climb, enter, ascend, descend, or traverse an archaeological resource, monument, or statue, in any park, beach or recreational facility except in designated areas and under conditions established by the Director. No person shall possess, destroy, injure, deface, remove, dig, or disturb any historic structure or its furniture or fixtures, or any other cultural or archaeological resource.
(f)
Improvements. No person shall possess, destroy, injure, deface, remove, dig or disturb any improvement or amenity, or any fence or gate, or any structure or its furniture or fixtures in any park, beach or recreational facility.
(g)
Wood. No person shall collect, use or possess any wood gathered within any park, beach or recreational facility, except in an area designated and under conditions established by the Director for the gathering of fuel wood for campfires or barbecues. Any person convicted of violating this subsection shall be guilty of an infraction.
(h)
Natural Products. The Director may designate certain fruits, berries, nuts, flowers or unoccupied seashells which may be gathered by hand for personal use or consumption, provided that such designation will not adversely affect wildlife or the reproductive potential of a plant species. No person shall gather, collect or possess natural products in a park, beach or recreational facility except in areas designated and under conditions established by the Director. No person shall collect natural products for sale or commercial use. Any person convicted of violating this subsection shall be guilty of an infraction.

Sec. 2-5-28. - Sanitation.¶
(a)
Use of Rubbish Receptacles. No person shall leave, deposit, drop or scatter any bottles, broken glass, ashes, wastepaper, cans or other rubbish, garbage, litter, food product, animal feed, refuse or offal matter in or on any park, beach or recreational area except in a designated trash receptacle. No person shall rummage through or remove the contents of any designated trash receptacle except in areas designated and under conditions established by the Director. No person shall deposit any such matter in the public toilets of any park, beach or recreational area.
(b)
Washing of Clothes and Utensils. No person shall wash clothing, dishes, cooking utensils or other utensils used in connection with the preparation or serving of food in any park, beach or recreational area except at places designated by the Director and provided for such purpose.
(c)
Cleanliness of Campsites. All persons using campsites shall keep said campsites safe, clean and free from rubbish, litter, broken glass, garbage, refuse or offal matter. Combustible rubbish may be burned where fires are permitted, and all other garbage and refuse of any kind shall be placed in containers or pits provided for that purpose.
(d)
Toilets and Refuse. No person shall discharge any human or animal excreta or waste water from a toilet or holding tank, except into tanks provided or designated for that purpose. Public toilets in parks, beaches and recreational areas are provided for the protection of the health of the general public and shall be used when so provided.

Sec. 2-5-29. - Vehicle regulation.¶
(a)
Speed. No person shall operate any vehicle in any park, beach or recreational area at a speed that is greater than is reasonable or prudent, having due regard for the traffic and traffic pattern, pedestrians, bicyclist and the surface and width of the roadway, streets or trails. In no event shall vehicles operate in excess of ten (10) miles per hour, unless a greater speed is posted.
(b)
Parking. No person shall park, stop or leave standing any vehicle whether attended or unattended in any park, beach or recreational area except in designated parking areas and shall not occupy more than one (1) parking space and shall not park in any area posted as" no parking" or block any gate, fire hydrant, fire lane, trail or roadway; however, the Director, or designee, is hereby authorized to permit parking along roads and in undeveloped areas within the park, beach or recreational areas when in his/her opinion such parking will not interfere with the operation of the park, beach or recreational areas.
(c)
Erection of Speed, Traffic and Parking Signs. The Director is authorized to erect and maintain signs at locations he/she deems appropriate indicating the speed limits established by the Board of Supervisors for parks and beaches along the roadways or streets therein. The Director is also authorized to designate parking areas and traffic patterns and to erect and maintain signs indicating such areas and patterns.
(d)
Removal of Vehicles. Vehicles may be removed and stored at the owner's expense by the Director or such of his/her employees as he/she may designate or by peace officers under any of the following circumstances:
(1)
The vehicle has been parked for a period of time longer than seventy-two (72) consecutive hours in any park, beach or recreational area.
(2)
The vehicle has been parked in a designated campsite where a fee is required and such fee has not been paid and appropriate signs have been posted.
(3)
The vehicle has been parked illegally, creating a hazard or disrupting public, private, or emergency access and pursuant to the California Vehicle Code.
(e)
Limited Time Parking Zone. No person shall have any vehicle stopped, parked or left standing, whether attended or unattended, in a limited time parking stall or space for more than the posted time period and appropriate signs have been posted.
(f)
Pay and Display. No person shall stop, park, or leave standing any vehicle whether attended or unattended in a park, beach or recreational area parking facility with an automated fee collection system, as designated by the Director, without properly displaying a valid current daily or annual parking permit.
(g)
Unauthorized Motor Vehicles. No person shall operate an unauthorized motor vehicle: Four-wheel drive vehicle, motorcycle, motor bike, motor dirt bike, all-terrain vehicle, off highway vehicle or any other motorized vehicle within any County owned, managed, or controlled reserve area, habitat sensitive area, wilderness area, natural area, open space area, undeveloped area, beach front area, turf area, or within river beds, stream beds, creek beds, wash areas, wetland areas, or recreational area trails.
For the purpose of subsection (g), "unauthorized motor vehicle" means any motorized vehicle that is driven upon said areas without written permission of the Director or his/her agents. This subsection does not apply to the operation of any publicly owned vehicle operated by a local, state or federal government agency, or by an authorized vehicle.
(h)
Vehicle Repair. No person shall repair, dismantle, overhaul or perform any mechanical work upon any type of vehicle, trailer or boat in any park, beach or recreational area, except to replace or otherwise repair a tire or to make emergency repairs to enable such vehicle, trailer or boat to be removed to a proper place.
(i)
Stop Requirements. The driver of any vehicle approaching a stop sign at the entrance to, or within, an intersection, within any park, beach or recreational area shall stop at a limit line, if marked, otherwise before
entering the intersection. If there is no limit line, the driver shall stop at the entrance to the intersecting roadway.
(j)
Dumping Prohibited. No person shall place, deposit or dump, or cause to be placed, deposited or dumped, any rocks, refuse, garbage, dirt or similar materials in or upon any park, beach or recreational area except in areas designated and under conditions established by the Director.
(k)
Hours of Operation. No person shall stop, park or leave standing any vehicle, whether attended or unattended, in a park, beach or recreational area at any time other than during established and posted hours of operation, except in areas designated and under conditions established by the Director.
(l)
Unlawful to Drive Unless Licensed. No person shall drive a motor vehicle, motorcycle, motor-driven cycle or motorized bicycle in or upon any park, beach or recreational area, unless the person is in possession of a valid driver's license of the appropriate class, certification or endorsement as provided for in the California Vehicle Code.
(m)
Yield Signs—Intersections. The driver of any vehicle in any park, beach or recreational area approaching any intersection which is controlled by a yield right-of-way sign shall, upon arriving at the sign, yield the right-of-way to any vehicles which have entered the intersection, or which are approaching on the intersecting roadway close enough to constitute an immediate hazard, and shall continue to yield the right- of-way to those vehicles until he or she can proceed with reasonable safety.
(n)
Motorized Wheeled Conveyance Prohibited. No person shall operate or drive any electric or combustible motorized skateboard, scooter, dirt bike, mini bike, mini motor bike, mini motorcycle, go-kart, go-ped, mo- ped, all-terrain-vehicle, quad runner, dune buggy or any similar electric or combustible motorized wheeled conveyance in any park, beach or recreational area, with the exception of Class 1 and Class 2 electric bicycles, as defined by the California Vehicle Code, on those regional paved, off-road bikeways designated for such use by the Director of OC Parks, with the approval of the Board of Supervisors.
(o)
Handicapped Parking—Special License Plate or Placard Required. No person shall stop, park or leave standing any vehicle whether attended or unattended in any park, beach or recreational area in a stall or space designated for disabled persons and disabled veterans pursuant to California Vehicle Code Section 22511.7 or 22511.8, unless the vehicle displays either a special identification license plate issued pursuant to California Vehicle Code Section 5007 or a distinguishing placard issued pursuant to California Vehicle Code Section 22511.55 or 22511.59.

Sec. 2-5-30. - Skateboards, roller skates and in-line skates.¶
(a)
Skateboards. No person shall ride a skateboard, including but not limited to scooters and mountain skateboards, or similar conveyances propelled by human power other than a bicycle or cause or permit same to roll or coast in any park, beach, or recreational area except in areas designated and under conditions established by the Director.
(b)
Roller Skates and In-Line Skates. No person shall ride roller skates, in-line skates, or similar conveyances propelled by human power other than a bicycle or cause or permit it to roll or coast in any park, beach, or recreational area where the Director has posted signs to prohibit such activity. No person shall ride roller skates, in-line skates, or similar conveyances on any unpaved trail in a park, beach or recreational area except in areas designated and under conditions established by the Director.

Sec. 2-5-31. - Interfering with agency functions.¶
(a)
Interference. No person shall threaten, resist, intimidate, or intentionally interfere with an employee of the County or other agent engaged in an official duty or on account of the performance of an official duty.
(b)
Lawful Order. No person shall violate the lawful order of a County employee or other agent authorized to maintain order and control public access and movement during fire fighting operations, search and rescue operations, wildlife management operations involving animals that pose a threat to public safety, law enforcement actions, and emergency operations that involve a threat to public safety or park resources, or other activities where the control of public movement and activities is necessary to maintain order and public safety.
(c)
False Information. No person shall knowingly give a false or fictitious report or other false information to a County employee or other agent in the conduct of official duty or on an application for a permit.
(d)
False Report. No person shall knowingly give a false report for the purpose of misleading a County employee or agent in the conduct of official duty, or make a false report that leads to an emergency or other response by the County or other agencies.

Sec. 2-5-32. - Sale or distribution of printed matter.¶
(a)
Printed Matter. No person shall sell or distribute printed matter in any park, beach or recreational facility except in areas designated and under conditions established by the Director. No person authorized by the Director to sell or distribute printed matter shall obstruct, impede or otherwise interfere with the free movement of any person in a park, beach, or recreational facility.
(b)
Decals. No person shall affix any decal, sticker or similar object to any improvement or amenity or any structure or its furnishings or fixtures in any park, beach or recreational area.

Sec. 2-5-35. - Alcoholic beverages.¶
No person shall, within the limits of any park, beach, harbor or recreational area, possess or consume any alcoholic beverage. This section shall not apply within any portion of any park, beach, harbor or recreational area that may be designated by resolution of the Board of Supervisors or for County- implemented events where possession or consumption of alcoholic beverages are so authorized at the discretion of the OC Parks Director or designee. Any authorized possession or consumption of alcoholic beverages shall be subject to reasonable policies and procedures enacted by the Director or designee for upholding the orderly administration and control of the parks, beaches, harbors and recreational areas within the County of Orange.

Sec. 2-5-36. - Disorderly conduct and noise.¶
No person shall fight or challenge another person to fight or maliciously and willfully disturb another person by loud and unreasonable noise or who uses offensive words that are inherently likely to provoke an immediate violent reaction in any park, beach or recreational facility.

Sec. 2-5-37. - Firearms, weapons, fireworks, replica firearms.¶
No person shall have any fireworks, firearms, replica firearms, air gun, paint ball gun, BB gun, slingshot or bow or hunting arrow or any weapon in his possession or in his vehicle other than in a closed trunk, storage compartment or other area separated from the passenger section of the vehicle, in any park, beach or recreational area, nor shall any person discharge any firearm, fireworks or weapon or display any replica firearm upon or into any park, beach or recreational area; provided, however, that the Director may designate areas in which such activity is permitted.

Sec. 2-5-38. - Disturbing or taking wildlife.¶
All recreational areas are sanctuaries for wildlife of every sort. No person shall hunt, kill, wound, feed, touch, tease, frighten, or intentionally disturb wildlife in any park, beach or recreational area, except persons in the performance of their official duties, or in areas designated and under conditions established by the Director.

Sec. 2-5-39. - Controlling domestic animals.¶
(a)
Leash Required. No person shall allow a dog, cat or other domestic animal in any park, beach or recreational area unless the animal is restrained at all times by a substantial leash not to exceed six (6) feet in length and in the control of a person competent to restrain the animal, or unless the animal is restrained and enclosed in a cage, crate or similar enclosure.
(b)
Unattended Animal. No person shall leave an animal unattended and tied to an object or confined in a vehicle in any park, beach or recreational area. Any person convicted of violating this subsection shall be guilty of an infraction.
(c)
Animal Wastes. All persons shall remove and properly dispose of animal excreta from any park, beach or recreational area. Any person convicted of violating this subsection shall be guilty of an infraction.
(d)
Designated Areas. No person shall allow a dog, cat or other domestic animal in any park, beach or recreational area except in areas designated and under conditions established by the Director.
(e)
Feral Animals. Any peace officer may authorize the impoundment of any at-large, feral or otherwise unattended or unrestrained domestic animal from a park, beach, or recreational area by an animal control officer or other qualified agent. The owner of an impounded animal is responsible for any and all fees, penalties or other costs associated with the impoundment.
(f)
Dog Shows. Nothing in this section shall prevent the County or its lessees from holding supervised public events in such recreational areas in which domestic animals participate, nor shall it prohibit the Director from issuing permits pursuant to section 2-5-25 for group activities wherein dogs will be under the responsible care of a person while not restrained by a leash or enclosed in a car, cage or similar enclosure while participating in a permitted canine event.
(g)
Domestic Animals in Park Waters. No person shall allow a dog, cat, or other domestic animal in any park waters except in areas designated and under conditions established by the Director.

Sec. 2-5-40. - Research specimens; permit required.¶
No person shall collect plants, wildlife, rocks, minerals, paleontological specimens or cultural or archaeological artifacts without a valid research-collecting permit in his or her possession. The Director shall establish conditions for issuance of a collecting permit in any park, beach, or recreational area, notwithstanding any and all permits required by State or Federal law. No person may possess, carry or use any trap, live trap, snare, net, kill jar or similar device without a valid permit issued by the Director pursuant to this section.

Sec. 2-5-41. - Rock climbing.¶
(a)
Climbing. No person shall ascend, descend or traverse, including aid climb, free climb, solo climb, or rappel, from any rock formation or structure in a park, beach or recreational area except in areas designated and under conditions established by the Director.
(b)
Bolts. No person shall place or cause to be placed any permanent or temporary climbing protection, including but not limited to bolts, hangers, chocks, bongs, cams, or friends, in a park, beach or recreational area except persons in the performance of their official duties or in areas designated and under conditions established by the Director.

Sec. 2-5-42. - Radio-controlled models.¶
No person shall possess or operate any radio-controlled or other remotely operated model, toy or similar device, including but not limited to cars, boats, rockets, airplanes or gliders, in any park, beach or recreational area except in areas designated and under conditions established by the Director. Any person convicted of violating this subsection shall be guilty of an infraction.

Sec. 2-5-43. - Bicycles.¶
(a)
Designated Trails. No person shall operate a bicycle on a road or trail in a park or recreational area except upon roads or trails designated for bicycle traffic by the Director.
(b)
Unsafe Operation. No person shall operate a bicycle in any manner that endangers any person or animal or at a speed that is greater than is reasonable or prudent, having due regard for other users and the surface, width, and grade of the road or trail, and in no event in excess of ten (10) miles per hour, unless a greater speed is posted.
(c)
Bicycle Parking. No person shall leave a bicycle lying on its side on a road or trail in a park, beach or recreational area in such a way to obstruct pedestrian, equestrian, or vehicle traffic. Any person convicted of violating this subsection shall be guilty of an infraction.
(d)
Helmets. No person under eighteen (18) years of age shall operate a bicycle, or ride upon a bicycle as a passenger on any road, bikeway or trail in any park, beach or recreational area unless that person is wearing a properly fitted and fastened bicycle helmet. The bicycle helmet must meet the standards pursuant to Sec. 21212 of the California Vehicle Code. Any person convicted of violating this subsection shall be guilty of an infraction.

Sec. 2-5-44. - Powerless flight.¶
No person shall operate any device designed to carry a person or persons through the air in powerless flight, including but not limited to hang gliders, paragliders, parasails, or parachutes, in a park, beach or recreational area except in areas designated and under conditions established by the Director.

Sec. 2-5-45. - Athletic activities.¶
No person shall conduct or participate in any sport or in any organized athletic activities within any park, beach or recreational area other than in such areas as may be designated for such sports, games or athletic activities, nor in any areas where the Director has posted signs prohibiting such activities.

Sec. 2-5-46. - Trails, trespassing and closed areas.¶
(a)
Designation and Use. The Director may designate horseback riding, bicycle riding and hiking trails in parks, beaches and recreational areas. The Director may also designate closed areas where entry is prohibited in the interest of public convenience or safety or for the preservation and protection of natural or cultural resources. No person may leave a designated trail in any park, beach or recreational area on foot, or on horseback or otherwise, other than for law enforcement, lifesaving or emergency purposes or for park, beach or recreational area management, at other than designated entry or exit points. No person shall enter on foot, or horseback or otherwise, any areas in any park, beach or recreational area or any trail or road which the Director has authorized be posted as a closed area.
(b)
Trespassing Along or Through Private Property. No person shall enter on or go upon the lands of another adjacent to or contiguous with any park, beach, recreational area or other County owned lands managed or operated by PFRD/HBP, whether under cultivation, enclosed by a fence or otherwise posted to prohibit trespass, for any purpose whatsoever, without the consent in writing of the owner of said premises or of the person or persons entitled to the use and occupancy thereof, except in the lawful performance of an official duty.

Gates. No person opening a closed gate shall proceed beyond said gate without first closing it.
(d)
Closure. The Director or designee may close parks, beaches and recreational areas and facilities and portions thereof when such areas and facilities are filled to capacity or a hazardous condition poses potential danger to citizens, County employees or County property. Any such closure shall be for the duration of said capacity or hazardous condition situation as determined by the Director.
(e)
Right-of-way. All persons shall observe posted right-of-way restrictions on any trail, path, walkway, or road owned, operated, or managed by the County of Orange. This subsection shall also apply to any such "trail courtesy" right-of-way regulations for multiple-use trails promulgated by the Director. Violation of this subsection is an infraction for the first violation and a misdemeanor for the second and subsequent violations.

Sec. 2-5-47. - Livestock and horses.¶
(a)
Saddle and Pack Animals. No person having custody or control of a horse or other saddle or pack animal shall allow said animal in any part of a recreational area except upon roads or bridle trails designated for equestrian traffic. No person shall ride or drive any horse or other animal which is not well broken and under the control of said person. No person shall ride any saddle animal in any manner that endangers any other person or animal. No person shall allow his saddle or pack animal to stand unattended or improperly tied.

Livestock. No person shall molest livestock in or adjacent to a park.
(c)
Loose Herding. No person shall free-trail or loose-herd horses or other pack or saddle stock in any park or recreational facility except as designated by the Director.

Sec. 2-5-48. - Construction.¶
No person shall erect structures within any recreational area without the consent of the Director and subject to applicable permits and building codes.

Sec. 2-5-49. - Diving/jumping.¶
No person shall dive or jump into any body of water in park, beach or any recreational area from any pier, bridge, rock or precipice other than at those places designated and posted for diving or jumping by the Director, as authorized by resolution of the Board of Supervisors. Violation of this section shall be an infraction.

Sec. 2-5-49.1. - Landing in water after having jumped or dived.¶
No person shall land in any body of water in any park, beach or recreational area after having jumped or dived from any pier, bridge, rock or precipice above such body of water, other than at those places designated and posted for diving and jumping by the Director, as authorized by resolution of the Board of Supervisors. Violation of this section shall be an infraction.

Sec. 2-5-50. - False drowning alarm.¶
No person in any park, beach or recreational area shall give or cause a false alarm of drowning to be given in any manner. Any person who knows that an alarm is false shall immediately notify HBP staff or other agents to whom said alarm was given of its falsity.

Sec. 2-5-51. - Equipment removal.¶
No person shall allow any equipment over which he or she has custody or control to remain at any park, beach or recreational area during any time that said recreational area is closed, unless authorized by the Director.
