Article 10 — SHERIFF

(a)

In honor of the memory of Robert Squires, Undersheriff of Orange County and all other law enforcement officers employed by the County of Orange or by cities located within the County of Orange who have lost their lives in the line of their duty, the Sheriff of Orange County is hereby directed to acquire and maintain a suitable portrait of each and every officer. Each such portrait shall be suitably framed and accompanied by a plaque attached thereto, upon which shall appear the name and appropriate factual information as to the officer portrayed.

(b)

Said portraits shall be displayed in some conspicuous place or places occupied by the Department of the Orange County Sheriff and preserved on display. This duty is hereby enjoined upon all future Sheriffs of the County of Orange. The provisions of Section 1-1-134 shall not apply to this section.

(a)

The County of Orange declares that it desires to qualify to receive aid from the State of California under the provisions of chapter 1 of title 4, part 4 of the California Penal Code.

(b)

Pursuant to section 13522 of said chapter 1, the County of Orange while receiving aid from the State of California pursuant to said chapter 1 will adhere to the standards for recruitment and training established by the California Commission on Peace Officers Standards and Training.

(a)

The County of Orange declares that it desires to qualify to receive aid from the State of California under the provisions of section 13510 (as amended by chapter 966 of the Statutes of 1981) chapter 1, of title 4, part 4, of the California Penal Code.

(b)

Pursuant to section 13522, chapter 1, the County of Orange and Municipal Court Marshal will adhere to the standards for recruitment and training established by the California Commission on Peace Officer Standards and Training (POST).

(c)

The County of Orange and Marshal will allow the Commission on POST and its representatives to make such inquiries as deemed appropriate by the Commission, to ascertain that the County of Orange and Municipal Court Marshal will adhere to the standards for recruitment and training established by the California Commission on POST.

Under the authority of California Government Code section 24300, the Board of Supervisors hereby consolidates the duties of the offices of Sheriff and Coroner.

(a)

Under the authority of Elections Code section 1300, the election to select the Coroner shall be held with the presidential primary.

(b)

The Coroner elected in 2022 shall serve a six-year term and the next election for that office shall occur at the 2028 presidential primary.

The Sheriff-Coroner is hereby directed to receive payments from prisoners serving sentences within the terms of California Penal Code section 1209, and said officer is directed to deposit all sums so received into the County treasury.

(a)

Pursuant to California Penal Code section 830.6(a)(2), those Reserve Deputies of the Sheriff-Coroner of Orange County who have completed two years and five hundred (500) working hours of field experience as Reserve Deputies, and qualified as Level 1 Reserve Deputies, pursuant to California Penal Code section 832.6(a)(1) and who have been and continue to be designated by the Sheriff-Coroner in writing as assigned to the prevention and detection of crime and the general enforcement of the laws of this state shall be deemed to be peace officers, and they shall possess the powers set out in California Penal Code section 830.1. The Sheriff-Coroner may revoke the authority of any such officer at any time.

(b)

All other Reserve Deputies shall be permitted to exercise the duties and functions described in California Penal Code sections 830.6(a)(1) and 832.6(a)(2) and (3) as they have been certified to perform by the California Commission on Peace Officers Standards and Training. The Sheriff-Coroner may revoke the authority of any such officer at any time.

No person may manufacture, sell, loan, give or transfer and no person shall receive or keep any authorized badge, insigne, emblem, or device of the Sheriff-Coroner, District Attorney, Probation Officer or Fire Department, or of any deputy or employee thereof, of this county without the written authority of the chief or head officer of such department or office or his designee or act in any manner contrary to any direction contained in any such written authorization with respect to the size, shape or design of such device or the method for transmission or delivery thereof.

(a)

The County of Orange declares that it desires to qualify to receive aid from the State of California under the provisions of sections 13522 and 13525, chapter 1, title 4, part 4, of the California Penal Code.

(b)

Pursuant to section 13510(c), chapter 1 of the California Penal Code, the Sheriff-Coroner, Marshal Department and General Services Agency/Communications Division will adhere to standards for recruitment and training established by the California Commission on Peace Officer Standards and Training (POST).

(a)

The County of Orange declares that it desires to qualify to receive aid from the State of California under the provisions of Section 13522 of the California Penal Code.

(b)

Pursuant to Section 13510(a) of the California Penal Code, the Sheriff-Coroner will adhere to standards for selection and training established by the California Commission on Peace Officer Standards and Training (POST).

(c)

Pursuant to Section 13512 of the California Penal Code, the commission and its representatives may make such inquiries as deemed appropriate by the Commission to ascertain that the Sheriff-Coroner's deputy coroner personnel adhere to standards for selection and training established by the Commission on Peace Officer Standards and Training.

The Sheriff-Coroner shall be responsible for the coordination of radio maintenance and engineering services to County organizations.

(a)

In accordance with Section 5 of Article XIV of the California Constitution, the Sheriff-Coroner is hereby authorized to negotiate contracts with other public entities in Orange County for the purpose of conducting programs, whereby County Jail inmates, with appropriate supervision, may perform unskilled labor.

(b)

Contracts with public entities for work by inmate labor crews shall be executed only after approval by the Board of Supervisors, unless the Board of Supervisors expressly authorizes the Sheriff-Coroner to execute such contracts on behalf of the County of Orange.

(c)

Said contracts shall provide for the recovery of no more than the full cost to the County of Orange of providing inmate work crews. The Sheriff-Coroner shall determine said cost by reference to the most current County cost study.

(d)

No inmate work crew shall perform any work that is required by law to be procured through competitive bidding or other competitive process, or any work in the same job classification as employees who are on strike as defined in Section 1132.6 of the California Labor Code as it read on January 1, 1990, or who are subject to lockout as defined in Section 1132.8 of the California Labor Code as it read on January 1, 1990.

(e)

Only convicted inmates who are incarcerated full time in the County Jail may be assigned to work crews.

(f)

The Sheriff-Coroner shall have discretion to determine which inmates shall be assigned to work crews, and nothing herein shall create an entitlement of any inmate to work on a work crew.

(g)

Inmates assigned to work crews shall not be employees of the County of Orange; shall not receive payment or any other form of consideration for their work on work crews; and shall not be entitled to any rights, privileges or benefits of County employees.

(h)

The purpose of this section is to promote inmates' contributions to public service and inmates' habits of work and responsibility.

(a)

The Board of Supervisors finds that inmates in the County's jail facilities have a legitimate interest in obtaining prompt bail bond agent and criminal defense attorney services. The Board of Supervisors further finds that the County has a legitimate interest in inmates receiving prompt bail bond agent and criminal defense attorney services because the criminal justice system is reasonably made more efficient and inmates' rights are better protected if these services are readily available to inmates. The Board of Supervisors further finds that revenue generated by signboards will ease the burden on taxpayers' funds used in keeping the jails.

(b)

In accordance with Government Code section 26109 and notwithstanding any other provision of this Code, the Board of Supervisors authorizes the placement of signboards in the County's jail facilities for the sole purposes of advertising licensed bail bond agents and criminal defense attorneys and raising revenue for the County. Placement of these signboards in the jail facilities is conditioned upon the Board of the Supervisors and the Sheriff's approval of one (1) or more agreements with provider(s) of such signboard services.

(a)

In accordance with Penal Code section 836.5, subdivision (d), the Board of Supervisors authorizes Sheriff Special Officers, appointed under Penal Code section 831.4, to arrest a person without a warrant whenever the Sheriff Special Officer has reasonable cause to believe that the person to be arrested has committed a misdemeanor in the presence of the Sheriff Special Officer that is a violation of a statute or ordinance that the Sheriff Special Officer has the duty to enforce.

(b)

The statutes and ordinances that a Sheriff Special Officer has the duty to enforce are the State of California codes, the Codified Ordinances of the County of Orange and the municipal codes of the cities in which County buildings or facilities are located where the Sheriff Special Officer provides security.

(c)

In making an arrest authorized by subsection (a) of this section, the Sheriff Special Officer will prepare a citation and release the arrestee for the misdemeanor in accordance with Penal Code section 853.6. If the

arrestee demands to be taken before a magistrate or the arrestee does not qualify for citation and release under Penal Code section 853.6, the Sheriff Special Officer will request a peace officer to take the person into custody for transport to jail.
