§ 8-16

The purpose of this chapter is to ensure adequate and uniform connectivity of all residential and commercial buildings to existing and future phone, cable and fiber-to-the-premises (FTTP) networks. (§ 1, Ord. 2883, eff. January 3, 2008)

(a) The provisions of this chapter shall apply to all new construction within the City for which a building permit is issued after the date of adoption. (b) The standards in this chapter are intended to comply with Part 68 of the Federal Communications Commission Rules and Regulations, the National Electrical Code, and the National Electrical Safety Code. In the event of a conflict between such Codes and Regulations and this chapter, the more restrictive standard shall take precedence. (§ 1, Ord. 2883, eff. January 3, 2008)

The City Manager or authorized representatives are hereby empowered and directed to administer and enforce the provisions of this chapter. No certificate of occupancy is to be approved unless the applicant has satisfied the enforcing authority that all provisions of this chapter have been met. (§ 1, Ord. 2883, eff. January 3, 2008)

(a) The provisions of this chapter are not intended to prevent the use of any material or method of construction not specifically prescribed by this chapter; provided, any such alternate has been approved by the enforcing authority; nor is it the intention of this chapter to exclude any sound method of structural design or analysis not specifically provided for in this chapter. Materials, methods of construction, or structural design limitations provided for in this chapter are to be used unless an exception is granted by the enforcing authority.

(b) The enforcing authority may approve any such alternate; provided, they find the proposed design, material, and method of work to be for the purpose intended at least equivalent to that prescribed in this chapter in quality, effectiveness, durability and safety. All single-family dwellings shall comply with the City of Ontario, Building Department, "Structured Wiring Standards – Residential Units" in effect as of the date of the building permit applicable to the single-family dwelling, which standards are hereby adopted by reference and made a part of this chapter. Copies of the "Structured Wiring Standards – Residential Units" shall be made available at the Building Department. (§ 1, Ord. 2883, eff. January 3, 2008)

All multiple dwelling units shall comply with the City of Ontario, Building Department, "Structured Wiring Standards – Residential Units" in effect as of the date of the building permit applicable to the multiple dwelling unit, which standards are hereby adopted by reference and made a part of this chapter. Copies of the "Structured Wiring Standards – Residential Units" shall be made available at the Building Department. (§ 1, Ord. 2883, eff. January 3, 2008)

All commercial units shall comply with the City of Ontario, Building Department, "Structured Wiring Standards – Commercial Units" in effect as of the date of the building permit applicable to the commercial unit, which standards are hereby adopted by reference and made a part of this chapter. Copies of the "Structured Wiring Standards – Commercial Units" shall be made available at the Building Department. (§ 1, Ord. 2883, eff. January 3, 2008)
