Chapter 21 — PARKS AND RECREATION

Sec. 21.1. - Definitions.¶
For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:
Park means any outdoor place set aside by the city for public use, recreation or other public purposes.
Parkway means that space between the street curb and the paved portion of the sidewalk.
Recreation includes any and all athletic, dramatic, intellectual and artistic activities performed by one person or by an ensemble under the auspices of the city.

Sec. 21.2. - Created; composition.¶
There is hereby created a city park and recreation department which shall consist of a superintendent and such other employees as the city council may from time to time determine.

Sec. 21.3. - Function.¶
The object of the park and recreation department shall be to promote all activities relating to public recreation and the care and maintenance of parks and parkways within the city.

Sec. 21.4. - Executive head.¶
The superintendent shall be the executive head of the park and recreation department and be in charge of all permanent employees attached to the department.

Sec. 21.5. - Personnel.¶
All permanent employees shall be subject to the provisions and rules and regulations of Chapter 23, but temporary or seasonal employees of this department shall not be subject to the provisions of Chapter 23, and the superintendent, with the approval of the city manager, may hire such temporary or seasonal employees as may be needed, on a per diem or contractual basis.

Sec. 21.6. - Superintendent—Appointment; salary; removal.¶
The superintendent shall be appointed by the city manager from the eligibility list as certified by the personnel officer at such salary as the city council may determine, and may be removed in accordance with the provisions of sections 23.39 to 23.54.

Sec. 21.7. - Same—Qualifications.¶
No person shall be entitled to take an examination under the provisions of Chapter 23 for the position of superintendent unless he possesses an academic degree from an approved college or university in which he has majored in recreation work and minored in botany, or, lacking such a degree, he shall have had not less than five years' practical experience in such or similar work as an employee of this or any other city.

Sec. 21.8. - Same—Bond.¶
The superintendent shall give a surety bond in the sum of two thousand dollars ($2,000.00), for the faithful performance of his duties.

Sec. 21.9. - Same—Duties generally.¶
The duties of the superintendent shall be as follows:
Planning, supervision. Plan, supervise, direct and execute all projects within the scope of the park and recreation department; and he shall be under the supervision of the city manager.
Recreations, custodianship. Be in charge of all recreation activities conducted in public parks or in buildings owned or operated by the city, and shall be responsible for the cleanliness and orderliness of any such parks or buildings.
Building rental. Be in charge of the rental of all spaces and the community center building and charge a reasonable rent therefor, except that no rent shall be charged to any organization sponsored by or being under the auspices of his department or any other department of the city.
Accounting for rents. Keep an accurate account of all funds received from rentals of the community center building or from rentals of other recreational facilities of the city and remit the same monthly to the city treasurer.
Reports. Give the city council a quarterly written report of all of his activities and give an additional report to the city manager upon his request.
Planting. Prepare and recommend to the council plans for the planting or removal of trees or shrubbery along and upon parkways or parks; and he shall have charge and control of the care of trees, plants and shrubbery in parks, parkways and along public streets.

Sec. 21.10. - Same—Additional duties.¶
In addition to the duties prescribed in section 21.9, the superintendent may be assigned to other city departments in any manner as the council or city manager may from time to time determine.
