§ 2-10. Removal or resignation generally.

- (a) The city council shall appoint the city manager for an indefinite term and may remove him by a three member vote. After the expiration of the six-month probationary period of employment, as set forth in section 2-7, such removal shall be accomplished in the following manner: At least thirty days before such removal becomes effective, the city council shall, by a three member vote of its members, adopt a preliminary resolution stating the reason for his removal. By the preliminary resolution the council may suspend the city manager from duty but shall in any case cause to be paid him forthwith any unpaid balance of his salary and his monthly salary shall continue to be paid for the next calendar month following the month of the adoption of the preliminary resolution. The city council, in removing the city manager, shall use its uncontrolled discretion and its action shall be final.

- (b) During his six-month probationary period of employment, the city manager may resign without notice. After the expiration of his six-month probationary period, the city manager may resign from his position by giving at least six weeks' written notice of the effective date of his resignation; provided that the city council may waive all or part of the six-week notice period. § 2-11. Removal after municipal election. [Ord. No. 394, § 7; Ord. No. 1144, § 1.]
Notwithstanding the provisions of this article, the city manager shall not be removed from office during or within a period of ninety days next succeeding any general municipal election held in the city at which election a member of the city council is elected. The purpose of this provision is to allow any newly elected member to the city council or a reorganized city council to observe the actions and ability of the city manager, in the performance of the powers and duties of his office. After the expiration of the ninety day period aforementioned, the provisions of the preceding section as to the removal of the city manager shall apply and be effective.

The city manager shall receive such compensation as the city council shall from time to time determine and fix. The compensation shall be a proper charge against such funds of the city that the city council shall designate.
