Article V — Industrial Users' Discharge Permits

§ 28-46. Revocation of permit.

Any user who violates the conditions of the waste discharge permit, any provisions of this chapter, applicable state or federal regulations, or any of the following, is subject to having the permit revoked within five days after written notification from the director:

  • (a) Failure of a user to factually report the wastewater constituents and characteristics of his discharge;

  • (b) Failure of the user to report significant changes in operations, or wastewater constituents and characteristics; or,

  • (c) Refusal of, or failure to provide, reasonable access to the user's premises for the purpose of enforcing this chapter. [Ord. No. 679, § 1(part), 1976.]

§ 28-47. Confidential information. [Ord. No. 679, § 1(part), 1976.]

All information and data on a user obtained from reports, questionnaires, permit application, permits and monitoring programs and from inspections shall be available to the public or any other governmental agency without restriction unless the user specifically requests and is able to demonstrate to the satisfaction of the city that the release of such information would divulge information, processes or methods which would be detrimental to the user's competitive position.

When requested by the person furnishing a report, the portions of a report which might disclose trade secrets or secret processes shall not be made available for inspection by the public but shall be made

available to governmental agencies for use in making studies; provided, however, that such portions of the report shall be available for use by the state or any state agency in judicial review or enforcement proceeding, involving the person furnishing the report.
