§ 5.60.090. Closing hours.¶
No person, as owner or operator of any establishment or portion of an establishment subject to this chapter shall keep the same open to the public or engage in any business activity whatsoever, other than the cleaning or maintenance of the premises or other usual activities involved in conducting the day's business, between the hours of 2:30 a.m. and 6:00 a.m.; provided, however, that pursuant to a valid permit to provide entertainment or conduct public dancing between the hours of 2:30 a.m. and 6:00 a.m., such person may keep open any such establishment during such hours solely for the purpose of conducting any activity authorized by such permit and strictly in accordance with the terms or conditions of such permit so long as no alcoholic beverages are sold, served or consumed on the premises during such hours.

§ 5.60.100. Application of provision.¶
Section 5.60.090 shall apply to all establishments, or the portions of all establishments, in which alcoholic beverages are normally sold, served or consumed, including multipurpose establishments selling alcoholic beverages for consumption on the premises, except as incidental to a bona fide restaurant operation conducted in the same room or rooms. Sale of alcoholic beverages shall not be deemed incidental within the meaning of this section if the receipts from the sale of food items, at their usual daytime prices, constitute less than 85% of the gross receipts of such establishment, for admissions, food, beverages or minimum-charges, between the hours of 2:30 a.m. and 6:00 a.m.

§ 5.60.110. Records of sales.¶
Any establishment selling alcoholic beverages and remaining open to the public after 2:30 a.m. or opening before 6:00 a.m. shall keep records which clearly segregate and reveal all gross receipts for the hours between 2:30 a.m. and 6:00 a.m., and shall permit inspection and copying of gross receipts by law enforcement authorities or by authorized City personnel or agents at all reasonable times.
