7.14.010 - Generally.

Any nuisance which the enforcement officer determines is immediately or potentially dangerous to the life, health, or safety of the occupants of the property or to the public, may be summarily abated in accordance with the procedures set forth in this chapter.

7.14.020 - Summary abatement procedures.

Actions taken to abate immediately or potentially dangerous nuisances may include, but are not limited to, repair or removal of the condition creating the danger and/or the restriction from use or occupancy of the property on which the condition exists or any other abatement action determined by the enforcement officer to be necessary. Where a residential rental property is involved, this may require the moving and relocation of the occupants by the owner and/or responsible party to other habitable temporary or permanent accommodations. Any temporary accommodations will be maintained by the owner and/or responsible party until the corrections are done to the vacated residential property so that it is habitable and the occupants are returned.

7.14.030 - Order.

When summary abatement is necessary, it shall be ordered only by the city manager or the acting city manager.

7.14.040 - Notice.

Notice of the summary abatement shall be provided to the owner and responsible party (if other than the owner) as provided for in this title as soon as practical.

7.14.050 - Cost recovery.

The costs and expenses for a summary abatement, if not paid by the property owner within thirty days of the date of the invoice, may be made a lien on the property and shall be collected pursuant to the procedures set forth in this title for the collection of fees, administrative costs and costs of abatement.

7.14.060 - Confirmation hearing.

Following any summary abatement pursuant to this chapter, the city shall conduct a hearing, following the procedures in Chapter 7.22, as soon as may be practicable to confirm the nuisance and condition(s) warranting the summary abatement.
