7.08.010 - Property owner responsibility.

It shall be the duty of the owner and/or the responsible party occupying or having charge or control of any parcel of land, improved or unimproved, to maintain such parcel of land free of any nuisance and/or nuisance conditions at all times as defined in Section 7.04.030. The same responsibility extends to the public rights-of-way or public land, related to any vehicle, vessel, structure, machinery, container, refuse, debris, or other item found to be or having been under the charge or control of a property owner, responsible party, or last registered or documented owner. Any owner or responsible party shall be responsible for the removal or correction of any nuisance or nuisance conditions and the costs for such removal or correction.

7.08.020 - Unlawful nuisance conditions.

It shall be unlawful for the owner of any real property and/or responsible party thereof to keep, maintain, or suffer to be maintained any real property in the city of Newark in a nuisance condition as defined in Section 7.04.030 and shall be punishable pursuant to Chapter 1.16 of this code. Each day that said nuisance condition continues shall constitute a new and separate offence.

7.08.030 - Administrative fines and penalties.

Pursuant to Government Code Section 53069.4, administrative fines and penalties which are in addition to all other legal remedies, criminal, civil or administrative, are hereby imposed. Any violation of the Newark Municipal Code shall be subject to an administrative fine or penalty. When the violation has been made an infraction by ordinance, the administrative fine or penalty shall not exceed the maximum fine or penalty amounts for infractions set forth in Government Code Section 36900(b). The amount of the fines or penalties for Municipal Code violations imposed pursuant to this title shall be as set forth in Chapter 7.20.
