§ 5.12.010. Definitions.¶
"Bingo,"
as used in this chapter means a game of chance in which prizes are awarded on the basis of designated numbers or symbols on a card which conforms to numbers or symbols selected at random.

§ 5.12.020. Compliance with chapter required.¶
Any bingo game shall be conducted within the city only in accordance with the provisions of this chapter.

§ 5.12.030. Permits—Application and criteria for issuance.¶
Any organization wishing to conduct a bingo game within the city must submit an application for a permit to the City Collector. Said application shall establish the following:
A. The organization conducting said bingo game must be exempt from the payment of the bank and corporation tax by Sections 23701(a), 23701(b), 23701(d), 23701(e), 23701(f), 23701(g) and 23701(l) of the state Revenue and Taxation Code, or must be a mobile home park association or senior citizens' organization.
B. The organization conducting said bingo game must utilize all profits for charitable purposes. With respect to organizations exempt from payment of the bank and corporation tax by Section 23701(d) of the state Revenue and Taxation Code, all profits derived from said bingo game shall be used only for charitable purpose. With respect to other organizations authorized herein to conduct bingo games, all proceeds shall be used only for charitable purposes except as follows:
Such proceeds may be used for prizes;
A portion of such proceeds not to exceed 20% of the proceeds after the deduction for prizes, or $1,000.00 per month, whichever is less, may be used for rental of property, overhead, and administrative expenses.
C. No person shall receive a wage, profit or salary in connection with the conducting of any bingo games.
D. No minor shall participate in any bingo game.
E. The bingo game shall be conducted only on property owned or leased by the organization seeking the permit and said property must be used for an office or for performance of the purposes for which the organization is established. Nothing herein shall require that the property owned or leased by the organization be used or leased exclusively by such organization.
F. All bingo games shall be open to the public and not just to members of the organization.
G. The bingo games shall be operated and staffed only by members of the organization which organized it and such members shall not receive a profit, wage or salary from the bingo game.
H. No individual, corporation, partnership, or other legal entity, except the organization seeking the permit, shall hold a financial interest in the conduct of any bingo game held under the permit.
I. All profit derived from the bingo game shall be kept in a special fund or account and not commingled with any other fund or account.
J. No person shall be allowed to participate in any bingo game unless said person is physically present at the time and place in which the bingo game is being conducted.
K. The total value of prizes awarded during the conduct of any bingo game shall not exceed the sum of $250.00 in cash or kind or both for each separate game which is held.

§ 5.12.040. Permit required—Fee.¶
The City Collector shall examine the application required by Section 5.12.030 and if the City Collector determines that the conditions set forth in Section 5.12.030 are true, the permit shall be issued upon payment of a license fee as set by resolution. Licenses shall expire on December 31st of each year and shall be renewable annually thereafter.
