§ 12.20.010. Approval required.

It is unlawful for any person to place, fasten, fix or maintain any benches or seats upon any sidewalks in this city, save and except that benches or seats approved by the Council may be placed, fastened, fixed or maintained upon any sidewalk when approval is granted by the Council to do so.

§ 12.20.020. Application for approval required—Contents.

Any person desiring to obtain approval to place, fasten, fix or maintain any bench or seat upon any sidewalk shall present and file with the City Clerk a written application setting forth the kind and character of such proposed bench or seat, its design, the materials with which the same is proposed to be constructed, the manner and method of its installation and fastening, the form of advertisement, if any, intended to be displayed thereon and the manner of such display, the dimensions thereof, the particular place where the same is to be placed or fastened, and shall accompany such application with a complete working plan of such bench or seat, drawn to scale, showing such design, form, materials to be used, manner and method of placing or fastening the same, and the form of advertisement, if any, to be displayed thereon.

§ 12.20.030. Action on application—Revocation of approval.

The City Clerk shall present said application to the Council at its next regular meeting, and the Council, at its discretion, may grant or deny such application, in whole or in part, and if it grants the same, shall prescribe such terms and conditions as to materials to be used in the construction of such bench or seat, the manner of placing or fastening the same, and other terms or conditions which the Council may determine as necessary for public safety, and any such approval shall be subject to revocation at any time by the Council.

§ 12.20.040. Issuance of approval.

The City Clerk, if such application is granted, shall issue, under his or her hand as City Clerk, and the official seal of this city, a certificate of approval containing the terms and conditions prescribed by the Council, and the statement that such approval is subject to revocation by the Council at any time.
