§ 10.38.010. Title.¶
This chapter of the Napa Municipal Code shall be known as the "Preferential Parking Permit Ordinance."

§ 10.38.020. Purpose.¶
This chapter is adopted pursuant to the preferential parking provisions of Section 22507 of the California Vehicle Code to designate preferential parking permit areas on the portions of city streets herein identified, to provide for the promulgation of administrative regulations to govern the issuance of preferential parking permits and administration of the preferential parking permit program, to clarify signage requirements for areas designated for preferential parking permits, and to identify those city streets designated as preferential parking permit areas.

§ 10.38.030. Definitions.¶
All words, phrases, and terms used in this chapter shall be interpreted in accordance with the definitions set forth in the California Vehicle Code, unless otherwise specifically defined herein. For purposes of this chapter, the following definitions shall apply:
"Police Chief"
shall mean the Chief of Police of the City of Napa, or designee of the Police Chief or the City Manager.
"Preferential parking permit"
shall mean a permit issued in accordance with this chapter which, when properly displayed on a vehicle, allows the vehicle to be parked on a street within a designated preferential parking permit area during restricted parking times.
"Preferential parking permit area"
shall mean the geographic areas formed in accordance with this chapter within which no motor vehicle may be parked on a street during restricted parking times unless the vehicle is authorized pursuant to this chapter.
"Restricted parking times"
shall mean times within which motor vehicle parking on a street is prohibited within a preferential parking permit area, unless the vehicle is authorized pursuant to this chapter.

§ 10.38.040. Preferential parking permit administrative regulations.¶
The Police Chief is authorized to establish and maintain written administrative regulations which implement the requirements of this chapter. A copy of the administrative regulations shall be maintained in the office of the City Clerk. The administrative regulations shall be approved by the City Manager, based on the recommendation of the Police Chief, and subject to the review and approval as to form by the City Attorney. The administrative regulations may include, but are not limited to, the following elements: requirements for applications for preferential parking permits, standards for issuance and form of preferential parking permits, procedures for revocation of preferential parking permits, standards of enforcement of parking within preferential parking permit areas, and requirements for signage of preferential parking permit areas.

§ 10.38.050. Posting of signs identifying preferential parking areas.¶
For every preferential parking permit area formed in accordance with this chapter, the city shall cause appropriate signs to be erected to provide reasonable notice to the public regarding the motor vehicles that are authorized to park in the preferential parking permit area during restricted parking times. The restricted parking times for any preferential parking permit area shall not be effective unless the signs required by this section have been erected.

§ 10.38.060. Unauthorized parking of motor vehicle in preferential parking permit areas.¶
Any person who parks a motor vehicle on a street in any preferential parking permit area formed pursuant to this chapter during restricted parking times shall be in violation of this code, unless the vehicle is authorized to be parked in the preferential parking permit area under the requirements of this chapter and any administrative regulation established pursuant to Section 10.38.040.

§ 10.38.070. Identification of preferential parking permit areas.¶
The preferential parking permit areas established under this chapter shall include the 30 perpendicular parking spaces along the western side of Brown Street between Fifth and Division Streets.
A. The 15 parking spaces immediately north of Division Street are hereby designated as preferential parking permit area spaces for the exclusive use of the employees, guests, visitors and invitees of the Napa City-County Library located at 580 Coombs Street. The restricted parking times for these spaces shall be for all hours of the day, seven days a week; provided, however, the city may, through the placement of signs or markings giving adequate notice thereof, establish restricted parking times for only those specified hours and days when the parking is needed to serve the Napa City-County Library.
B. The 15 parking spaces immediately south of Fifth Street are hereby designated as preferential parking permit area spaces for the exclusive use of the employees, guests, visitors and invitees of the property contained within the Napa Mill Planned Development Overlay District, as the boundaries of that zoning district are set forth under City of Napa Ordinance No. 2012-10. The restricted parking times for these spaces shall be for all hours of the day, seven days a week.
