10.08.010 - Definitions.

Whenever in this article terms, conditions or phrases are used which are not defined herein, but which are defined in the Vehicle Code of the state, the definition and meaning shall be applied as set forth and contained in the provisions of the Vehicle Code, and amendments thereto.

10.08.020 - Application of article provisions.

This article shall be only deemed to apply to the highways, roads and streets of the unincorporated area of the county and any city streets upon which there is an ordinance in effect permitting the use of such street by the board of supervisors of the county for the purpose of constructing and maintaining thereon a highway as part of a county system of roads.

10.08.030 - Board of supervisors authority.

The county board of supervisors may, by resolution, determine and designate the location of through highway and intersection stops, parking time limits within any designated area within the county, designate particular highways, roads and streets as one-way highways, roads and streets, and require that all vehicles thereon be moved in one specific direction, close any highway, road or street to traffic, or prohibit parking thereon on any part or portion thereof, and it is hereby authorized and directed to place, paint and maintain, or cause to be placed, painted or maintained the necessary signs, markers or painted curbs in accordance with the provisions of the Vehicle Code of the state and amendments thereto.

10.08.040 - Driver obedience required.

It is unlawful for the driver of any vehicle to disobey the instructions of any traffic sign or marker upon any highway, street or road placed in accordance with the provisions of this chapter, and it shall be made the express duty of the sheriff of the county, and any constable of the county within his respective township, to enforce the provisions of this article and any resolution of the board of supervisors adopted pursuant hereto.

10.08.050 - Stops at through highways and intersections.

Every driver of a vehicle shall stop such vehicle before entering or crossing any through highway, street or road, and before entering or crossing any intersection designated as a stop intersection at any entrance thereto designated as a stop entrance, and all such stops shall be made at the prolongation of the property line of the through highway or intersection, or at such other place properly marked and designated as a stop location as may all be designated or determined by resolution of the board of supervisors; provided, however, that no such stop need be made when traffic is signaled to proceed by a peace officer.

10.08.060 - Passenger unloading by common carriers.

Buses engaged as common carriers, school buses and taxicabs are authorized to stop in front of public or private driveways to load or unload passengers.

10.08.070 - Milton Road area—Commercial vehicle use restrictions.

Pursuant to the provisions of California Vehicle Code Section 35712, all commercial vehicles exceeding the gross weight of fourteen thousand pounds are prohibited from using Milton Road, in either direction, as Milton Road extends southerly of the Napa Valley Marina.

10.08.080 - Residential zone truck, bus and RV parking.

A. No person shall stop, stand or park any truck, commercial trailer or bus, except panel delivery trucks or pickup trucks, upon any public street within a residentially zoned area in the unincorporated portion of the county between the hours of six a.m. and twelve midnight, for a period longer than four hours, nor shall any person stop, stand or park any truck, commercial trailer or bus, except panel delivery trucks or pickup trucks, upon any public street within a residentially zoned area in the unincorporated portion of the county between the hours of midnight and six a.m.

B. No person shall stop, stand or park any recreational vehicle, including motor homes, mobilehomes, recreational travel trailers or campers, upon any public street within a residentially zoned area in the unincorporated portion of the county for a period longer than seventy-two hours.

C. Each day a violation occurs under this section shall constitute a separate violation.

10.08.090 - Temporary parking restrictions.

A. The sheriff of the county may temporarily prohibit or restrict any vehicle parking or being operated upon any highway, street or road in the county in the case of parades, celebrations, public assemblages or when large crowds of people and vehicles are to gather or have gathered or in the case of the collapse of a building, conflagration or obstruction or damage to any highway, street or road or portion thereof or when any other emergency condition exists which, in his judgment, requires the same, by placing temporary appropriate signs upon such highway, street or road giving notice of such prohibition or restriction. It shall, however, be the duty of the sheriff, except in cases of emergency which require, in his judgment, immediate action, to obtain the consent of the member of the board of supervisors in whose supervisorial district such sign or signs are to be placed before prohibiting or restricting the parking. The temporary prohibition or restriction by the sheriff shall be effective until the meeting of the board of supervisors next ensuing to which the board the sheriff shall report in writing his action and his recommendations as to a continuance of said prohibited or restricted parking or traffic.

B. It is unlawful for any person to stop, stand or park a vehicle in violation of the prohibition or restriction or to disobey the lawful order of any sheriff or any sheriff's deputy or constable or of the peace officer directing the removal or diverting of a vehicle from said highway, street, road or area.

C. It is unlawful for any person to operate a vehicle, other than merely stopping, standing, or parking the same, in violation of said prohibition or restriction or to disobey the lawful order of any sheriff or any sheriff's deputy or constable or of the peace officer directing the removal or diverting of a vehicle from said highway, street, road or area.

10.08.100 - Bicycle riding and animal restrictions.

Every person riding a bicycle or riding or driving an animal upon a highway, street or road is subject to the provisions of this article applicable to the operator of a vehicle, except those provisions which by their very nature can have no application.

10.08.110 - Obstructing roadway unlawful.

It is unlawful for any person to operate or stand or park any vehicle on any highway, street or road in such manner as to obstruct the free use of such highway, street or road.

10.08.120 - Violation of Article I—Penalty.

Any violation of the provisions of this article, including the commission of any action declared to be unlawful by any provision of this article, which pertains to operation of a vehicle other than standing or parking shall constitute an infraction punishable as prescribed by Section 25132(b) of the California Government Code.

10.08.125 - Parking and standing violations subject to civil penalties.

Any violation of the provisions of this article, including the commission of any action declared to be unlawful by any provision of this article, which pertains to standing or parking, shall not be a criminal violation but shall instead be subject to a civil penalty as prescribed by Vehicle Code Section 40200 et seq. and Chapter 10.32.
