2.72.010 Establishment of city of Murrieta Foundation.

There is hereby established the city of Murrieta Foundation. It shall consist of five members who shall be members of the city council. The terms of office shall coincide with the respective city council member's term of office. The mayor shall serve as chairman and the mayor pro-tem shall serve as vice-chairman.

2.72.020 Meetings—Rules of procedure.

The Foundation shall hold meetings as necessary, which meetings shall be held in conjunction with a regular or special city council meeting. The rules shall be those rules applicable to the conduct of meetings of the city council.

2.72.030 Purpose.

The city of Murrieta Foundation shall serve as conduit for the solicitation and receipt requiring of funds to be dedicated to specific charitable purposes; i.e., the Murrieta Library or the Murrieta Senior Center. The foundation shall accomplish this by the conducting of charitable fund raising events, funds solicitation, grant applications and any other means of obtaining charitable contributions. The determination of the specific charitable use of funds shall be within the discretion of the board of directors of the foundation.

2.72.040 Maintenance of separate funding and accounting.

All funds obtained by the foundation shall be maintained in a separate account held by the city and shall be expended only for the charitable purpose specifically authorized by the board of directors. The only expenses charged against the foundation account shall be those expended in obtaining and administering the funds collected. The account shall be audited annually in conjunction with the audit performed for the city of Murrieta.

2.72.050 Application to Brown Act.

The provisions of the Ralph M. Brown Act, being Government Code Section 5495 et seq. shall be specifically applicable to the board of directors of the foundation. It shall not be applicable to any ad hoc subcommittee of the board of directors comprised of less than a quorum of the board, nor to meetings of volunteers assisting in special events for charitable solicitations.

2.72.060 Charitable contributions/tax deductibility.

Any contributions received by the foundation shall be considered to be charitable contributions to the city of Murrieta for the purposes of federal and state income deductibility.
