5-6-200 - General Authority.

The City is authorized under Article 2 of Chapter 13 of Part 2 of Division 3 of Title 4 of the Government Code ["Weed and Rubbish Abatement, Alternative Procedures"] (§§ 39560—39588), hereafter the "Statutory Abatement Procedures," to declare an accumulation of weeds, hazardous vegetation and other combustible material to be a public nuisance and to provide for the cost of removal collected under Government Code sections 39577—39581.

The City is authorized, under Government Code section 39572, to enter private property to: abate the nuisance.

The City is further authorized to make violation of any City ordinance subject to an administrative fine pursuant to Government Code section 53069.4.

5-6-201 - No Mandatory Duty of Care.

This Division is not intended to and shall not be construed or given effect in a manner which imposes upon the City, or any officer or employee thereof, a mandatory duty of care towards persons or property within the City or outside the City so as to provide a basis of civil liability for damages, except as otherwise imposed by law.
