7.28.010 - Purpose.¶
The purpose of this chapter is to combat mosquito and other disease vector sources and prevent the transmission of the West Nile Virus within the town of Moraga. Under the provisions of this chapter, administrative citations may be issued for the creation or maintenance of conditions that support the development, attraction or harborage of mosquitoes or other vectors.

7.28.020 - Definitions.¶
For the purposes of this chapter, the following terms shall have the meaning given in this section:
A. "Vector" means any animal capable of transmitting the causative agent of human disease or capable of producing human discomfort or injury, including, but not limited to, mosquitoes, flies, mites, ticks, other arthropods, and rodents and other vertebrates.
B. "Designated employee" means any individual designated by the town of Moraga as qualified to determine that a violation of Section 7.28.030 has occurred and authorized to issue an administrative citation to any person in accordance with the provisions of Article 2 of this chapter.

7.28.030 - Creation or maintenance of conditions supporting vectors prohibited.¶
No person shall create, cause, commit or maintain:
A. Any artificial alteration of property, excluding water, from its natural condition, resulting in it supporting the development, attraction or harborage of vectors, with the presence of vectors in their developmental stages on property being prima facie evidence that this section is being violated;
B. Any water that is a breeding place for vectors, with the presence of vectors in their developmental stages in the water being prima facie evidence that this section is being violated; or
C. Any activity that supports the development, attraction or harborage of vectors, or that facilitates the introduction or spread of vectors.

7.28.040 - Enforcement.¶
In addition to any other enforcement remedy provided at law, violations of Section 7.28.030 may be subject to the administrative citation procedure set forth in Article 2 of this chapter.
