Moraga Municipal Code Art. 2 Special Noise Sources

It is unlawful for a person within a residential zone of the town to use or operate a radio receiving set, musical instrument, phonograph, television set, or other machine or device for the producing or reproducing of sound (between the hours of ten p.m. of one day and eight a.m. of the following day) in such a manner as to disturb the peace, quiet and comfort of neighboring residents or of a reasonable person of normal sensitiveness residing in the area.

It is unlawful for a person to sell anything by outcry within an area of the town zoned for residential use. This section does not prohibit the selling by outcry of merchandise, food and beverages at licensed sporting events, parades, fairs, circuses, and other similar licensed public entertainment events.

It is unlawful for a person to use a drum or other instrument or device of any kind for the purpose of attracting attention by the creation of noise where such noise disturbs the peace, quiet and comfort of neighboring residents or of a reasonable person of normal sensitiveness residing in the area. This section does not apply to a person who is a participant in a school band or licensed parade or who is otherwise authorized to engage in such conduct.

It is unlawful for a person to create noise on any street, sidewalk or public place adjacent to a school, institution of learning or church while it is in use, or adjacent to a hospital, if the noise unreasonably interferes with the workings of the institution or if the noise disturbs or unduly annoys a person in the hospital. However, this section is effective only if a conspicuous sign is displayed in a street, sidewalk or public place indicating the presence of a school, church or hospital.

No person shall keep or maintain or permit the keeping of an animal or fowl upon premises owned, occupied or controlled by him or her which is otherwise permitted to be kept if by any sound, cry or behavior the animal or fowl causes annoyance or discomfort to a reasonable person of normal sensitiveness in a residential neighborhood in the quiet and peaceful enjoyment of his property.

It is unlawful for a person to operate machinery, equipment, pump, fan, air-conditioning apparatus or similar mechanical device which disturbs the peace, quiet and comfort of neighboring residents or a reasonable person of normal sensitiveness residing in the area in the quiet and peaceful enjoyment of his property.
