Moraga Municipal Code § 3 Penalties

In accordance with Government Code section 50022.4, the following penalty clauses contained in the Ordinance Code of Contra Costa County are enacted in full, as amended to refer to the Moraga Municipal Code:
(a)Repealed by Ord. 164
(b) Section 51-4.404 (regarding General Welfare and Business Regulations), which reads:
"51-4.404 Most violations are infractions. Notwithstanding Section 14.8.002 of this code, violations of this Title 5 [General Welfare and Business Regulations] are misdemeanors, except violations of Chapter 54-10 (Rewards) and Chapter 54-14 (Open Alcohol Containers),… which are infractions."
(c) Section 54-16.008 (regarding open alcoholic containers in public places), which reads:
"Section 54-16.008 Infraction. Any person who is convicted of a violation of any provision of this chapter [Open Alcoholic Containers in Public Places] is guilty of an infraction and shall be punished as provided in Moraga Municipal Code section 1-303."
(d) Section 1008.2.024 (regarding Utilities), which reads:
"1008-2.024 Violation—Penalty. Any violation of this chapter [Utilities] by any person, firm, corporation, partnership, association, or any combination of these acting together shall be a misdemeanor punishable pursuant to the provisions of Moraga Municipal Code section 1-302."
