14.18.010 - Definitions.

"Camping" as used in this Chapter is defined as one or more of the following: erecting a tent or shelter for the purpose of sleeping; arranging bedding for the purpose of sleeping; or use of a standing or parked vehicle for the purpose of sleeping.

14.18.020 - Camping prohibited on public property.

A. No person shall camp in the right-of-way of State Highway One between the Carmel River and the Monterey-San Luis Obispo County Line at any time.

B. No person shall camp between the hours of six p.m. and six a.m. on any:

  1. Public road, or

  2. Public property, except when the public property is expressly designated and posted for overnight camping.

14.18.030 - Camping prohibited on private property.

No person shall camp on private property, including but not limited to beaches, vacant lots, parking areas and commercial properties, between the hours of six p.m. and six a.m., unless the person camping on such private property:

A. Is the owner or the lessee of such property or the house guest of such owner or lessee, or

B. Has the permission of the owner of such property, the owner's agent or person in lawful possession of such property and sanitary facilities approved by the Health Officer of the County are available on the property to the person camping on the property.

14.18.040 - Enforcement.

A. It shall be at the discretion of the peace officer enforcing this Chapter to determine if the person sleeping or resting in his or her vehicle is doing so for health or safety purposes. The peace officer shall not issue a citation if the peace officer reasonably believes that the person sleeping or resting in his or her parked vehicle is doing so the health or safety purposes unless the area in which the vehicle is parked is specifically posted or signed as a no parking area.

B. A violation of Section 14.18.020(A) of this Chapter shall be punishable by a civil penalty of not more than one thousand dollars ($1,000).
