1.12.010 - Work furlough—Findings.¶
1.12.020 - Work furlough—Administrator designated.¶
1.12.030 - Transfer of inmates on work furlough program.¶
1.12.040 - Prohibited communications and contacts with prisoners.¶
A. Every person who, without the permission of the peace officer or correctional officer in charge of any prisoner, communicates or attempts to communicate with the prisoner while that prisoner is outside the county jail, state prison, state hospital or other facility where the prisoner is confined is guilty of an infraction.
B. Every person who, without the permission of the peace officer or correctional officer in charge of any prisoner, does any of the following acts while the prisoner is outside the county jail, state prison, state hospital or other facility where the prisoner is confined is guilty of a misdemeanor:
Communicates or attempts to communicate with the prisoner after receiving a verbal warning from the peace officer or correctional officer not to communicate or attempt to communicate with the prisoner;
Makes or attempts to make physical contact with the prisoner;
Delivers or attempts to deliver any item to the prisoner;
Receives or attempts to receive any item from a prisoner,
C. Every person who violates Subsection A of this Section and who has a prior conviction for violating Subsection A of this Section is guilty of a misdemeanor.
D. The District Attorney may charge any violation of Subsection B or C of this Section as an infraction.
E. A peace officer authorized in the Penal Code to issue a notice to appear may designate a violation of Subsection B or C of this Section as an infraction on the notice to appear.
F. "Prisoner" as used in this section includes a minor who is confined in juvenile hail or any other facility while outside the minor's place of confinement in the custody of a peace officer, correctional officer or probation officer.
