8.06.010 - Purpose.

The Monte Sereno Better Streets Commission (hereinafter referred to as the "Commission") is hereby established and created.

8.06.020 - Membership and criteria for appointment.

A. The Commission shall consist of five (5) members of the public selected by a majority of the City Council. In addition, one (1) member of the Youth Commission shall serve on the Commission as an ex officio member. Such Youth Commissioner shall be selected by a majority of the City Council. Each Commissioner shall serve a term of two (2) years and can be reappointed by a majority of the City Council.

B. All members of the Commission shall be residents and registered voters of the City, with the exception of the Youth Commissioner who must only be a resident of the City of Monte Sereno.

C. All members of the Commission shall have backgrounds, experience and/or interest in traffic, bicycle, and pedestrian safety, street standards, storm water management, or sustainable infrastructure.

8.06.030 - Appointment process.

A. Members of the Commission shall be appointed by a majority of the City Council.

B. Member terms shall be staggered so that no more than three (3) terms will expire in any one (1) calendar year. For purposes of appointing the first Commission, three (3) members shall be appointed to serve a two-year term expiring December 31, 2019, and two (2) members shall be appointed to serve a one-year term expiring December 31, 2018. The Youth Commission member shall serve a two-year term expiring on December 31, 2019.

8.06.040 - Removal process.

Any member of the Commission may be removed for the following reasons:

A. The member ceases to be a resident of the City.

B. The member fails to attend three (3) consecutive regular Commission meetings without an approved excuse by the Commission.

C. The member is removed by a majority vote of the City Council.

8.06.050 - Commission duties and responsibilities.

The Commission shall advise the City Manager on the design, operations and maintenance of the Monte Sereno street system by putting people first, considering pedestrians, bicyclists, transit, traffic controls, lighting, vehicular circulation and parking. It shall identify and advise on integrated, coordinated, environmentally sustainable and economically efficient street rehabilitation solutions that address multiple demands on the street system such as underground utilities, street trees, storm water management and contamination runoff issues. The Commission shall have no independent duties and no authority to take actions on behalf of the City. The City Manager may refer any recommendation from the Commission to the City Council for direction.

8.06.060 - Rules and procedures.

The Commission may adopt rules and procedures governing the actions of the Commission. Before the rules and procedures become final, they must be filed with the City Clerk and approved by the City Council.

8.06.070 - Commission Secretary.

The City Manager, or his/her designee, shall serve as the Secretary for the Commission and shall be responsible for providing Commission meeting notices and maintaining the records of the Commission, including minutes of Commission meetings.

8.06.080 - Commission Officers.

The Commission shall elect one (1) member of the Commission to serve as Chairperson of the Commission for a period of one (1) year. The Commission shall elect one (1) member of the Commission to serve as Vice Chairperson for of the Commission for a period of one (1) year. For purposes of electing these offices for the first Commission, the Chairperson and Vice Chairperson must be serving a term that shall terminate on December 31, 2019.

8.06.090 - Commission meetings.

The Commission shall set the regular date and time for Commission meetings in its rules and procedures outlined in Section 8.06.060. The Commission shall meet no less frequently than once every three (3) months. All meetings shall be open to the public. The Commission may call a special meeting at any time in accordance with Government Code Section 54956.

8.06.100 - Conduct of business.

In order to conduct business, a quorum of the Commissioners must be present at a noticed meeting. A quorum is defined as a majority of the number of Commissioners seated at any one (1) time, but in no event less than three (3) Commissioners.
