2.20.010 Municipal elections.¶
Pursuant to Section 36503 of the California Government Code and Sections 1301, 1000 and 10403.5 of the California Elections Code, beginning in November of 2014 and every even-numbered year thereafter, the City of Montague's general municipal election shall be consolidated with the statewide general election held on the second Tuesday following the first Monday in November. 2.20.015 County clerk to render specified services relating to conduct of municipal elections.¶
The city does request the Board of Supervisors of the County of Siskiyou to permit the county clerk to render the following specified services to the city relating to the conduct of the regularly scheduled municipal elections.
A. The city's general municipal elections shall be conducted in accordance with all of the applicable procedural requirements of the California Elections Code pertaining to the statewide general elections and, commencing in November of 2014, shall thereafter occur in consolidation with those elections;
B. The county clerk is authorized and directed to perform all necessary duties related to the legal conduct of the municipal elections to be held in conjunction with the California general elections held in even-numbered years;
- C. The polls shall remain open as scheduled for such elections, the day of the regularly scheduled election; and
D. The county shall bill the city and the city shall reimburse the county in full for the above services. (Ord. 13-08, 2013; Ord. 96-03, 1996)
2.20.020 Effect on terms of incumbents.¶
A. In accordance with the provisions of paragraph (d) of California Elections Code Section 10403.5, any city officer whose terms of office would have expired under former Municipal Code Section 2.20.020 and prior to the adoption of the ordinance codified in this chapter, shall instead continue in the office until the next regularly scheduled city council meeting after receipt of the certification of the results from the county elections official following the statewide election.
B. The city's general municipal election consolidated with the statewide general election shall be held in November of 2014, at which time the seats of the council members that would have been up for election at the prior scheduled date for a general municipal election shall be up for election. The seats of the remaining council members shall be up for election at the next general municipal election, which shall be consolidated with the statewide general election to be held in November of 2016. 2.20.030 Notification of registered voters indicating change.¶
Within thirty days after the ordinance codified in this chapter becomes operative, the city clerk shall cause a notice to be mailed to all registered voters in the city informing the voters of the change in the election date and that as a result of the change in the election date, elected city office holders' terms of office will be changed. (Ord. 88-15 § 3, 1988)
2.20.040 Appointment of mayor and mayor pro tempore—Term.¶
The city council shall meet on the Tuesday after the general municipal election and choose one of its members as mayor and one of its members as mayor pro tempore. Both shall serve for a period of two years. In years in which there is no general election, the election of mayor and mayor pro tempore shall occur during the regularly scheduled meeting to be held on the third Thursday of April in any such year. 2.20.050 Provisions operative when.¶
The city clerk shall submit this ordinance to the Siskiyou County Board of Supervisors for approval by such body in accordance with California Elections Code Sections 1301(b) and 10403.5. This ordinance shall become operative upon approval by the board of supervisors. (Ord. 13-08, 2013; Ord. 88-15, 1988)
2.20.060 Severability.¶
If any section, subsection, part, clause, sentence or phrase of this ordinance or the application thereof is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, the validity of the remaining portions of this ordinance, the application thereof, shall not be affected thereby but shall remain in full force and effect, it being the intention of the city council to adopt each and every section, subsection, part, clause, sentence or phrase regardless of whether any other section, subsection, part, clause, sentence or phrase or the application thereof is held to be invalid or unconstitutional.
