§ 5.38.010 DEFINITIONS.

As used in this chapter the terms “peddler,” “solicitor,” and “itinerant vendor” shall be as defined in § 5.04.030.

§ 5.38.020 LICENSE REQUIRED.

No person shall engage in, conduct or carry on the business of peddler, solicitor or itinerant vendor without first obtaining a license therefor, a copy of which must be carried at all times.

§ 5.38.030 BADGE REQUIRED.

No person shall engage in, conduct or carry on the business of peddler, solicitor or itinerant vendor without at all times wearing a badge which shall be issued to each licensee by the License Collector. The badge shall indicate the expiration date of the license, the individual's name, and the company name if applicable.

§ 5.38.040 “NO SOLICITATION” SIGNS.

No peddler, solicitor or itinerant vendor, for the purpose of peddling, soliciting or vending, shall ring the bell or knock on the door of, or otherwise attempt to gain admittance to, any place, residence, or dwelling, including but not limited to any house, apartment, or condominium, where there is a sign indicating “no solicitors” or words of similar import indicating that peddlers, solicitors and vendors are not wanted on the premises. This section shall not apply to any peddler, solicitor or itinerant vendor who rings any bell or knocks on any door at the invitation or with the consent of an adult resident of the place, residence or dwelling.

§ 5.38.050 REQUESTS TO LEAVE.

(A) No peddler, solicitor or itinerant vendor shall offer for sale, demonstrate, attempt to sell, solicit or attempt to solicit orders for goods, wares, or merchandise of any kind or character, or any article, materials or substance, at or in any place, residence, or dwelling, included but not limited to any house, apartment, or condominium after having been requested to leave such place or residence by a person or tenant in lawful possession thereof.

(B) No peddler, solicitor or itinerant vendor shall refuse to leave any place, residence, or dwelling, including but not limited to any house, apartment, or condominium, or any portion of the premises thereof, when requested to leave by a person or tenant in lawful possession thereof.

§ 5.38.060 PROHIBITED HOURS.

No peddler, solicitor or itinerant vendor shall offer for sale, demonstrate, attempt to sell, solicit or attempt to solicit orders for goods, wares, or merchandise of any kind or character, or any article, materials or substance between the hours of 9:00 p.m. and 9:00 a.m. of the following day.

§ 5.38.070 STATIONARY SALES LOCATIONS PROHIBITED.

(A) No peddler, solicitor or itinerant vendor shall set up sales displays, sales tables, or similar paraphernalia either on public or private property for the purpose of peddling, soliciting or vending.

(B) No person shall engage in, conduct or carry on the business of peddler, solicitor or itinerant vendor within the limits of any one block for more than 20 minutes, and shall not, within a period of four hours, peddle, solicit or vend within the limits of such block. BLOCK, as used herein, shall mean either side of the portion of any street between two consecutive intersecting streets.
