§ 12.16.010 INTERFERENCES WITH PASSAGE OF VEHICLES AND PEDESTRIANS—DECLARED NUISANCE.

The growth or existence upon the sidewalk of any public street, or upon any premises abutting thereon, of bushes, hedges or trees, or any other type or kind of obstruction, which in any manner interfere with or obstruct the passage of pedestrians or vehicles along any such sidewalk or street, or the use of such street for parking, movement or other vehicular uses are each hereby declared to be a nuisance.

Whenever any bush, hedge or tree, or any other type or kind of obstruction upon the sidewalk of any public street, or upon any premises abutting thereon, interferes with or obstructs the passage of pedestrians or vehicles along such sidewalk or street, or the use of such street for parking, movement or other vehicular uses, written notice shall be given to the owner, tenant or person having charge or control of the premises on or in front of which such bush, hedge or tree is situated, to abate such interference or obstruction by trimming or removing such bush, hedge or tree, and it shall be a misdemeanor for such owner, tenant or person having charge or control of such premises to neglect or fail to abate such interference or obstruction by trimming or removing such bush, hedge or tree within ten days after service upon him of the notice.

§ 12.16.030 WEEDS WITH WINGY OR DOWNY SEEDS DECLARED NUISANCE—NOTICE TO REMOVE.

Whenever there shall be growing or existing upon the sidewalk or parkway of any public street, any weeds whose seeds are of a wingy or downy nature, and are of a type which are scattered by the wind, the same are hereby declared to be a nuisance, and written notice shall be given to the owner, tenant, or person having charge or control of the premises, in front of which such weeds are situated, to remove such weeds, and it shall be a misdemeanor for such owner, tenant or person having charge or control of the premises to neglect or fail to remove such weeds from the sidewalk or premises within ten days after service upon him of such notice.

§ 12.16.040 REMEDIES CUMULATIVE.

The remedies and procedures provided in this chapter shall be cumulative to other remedies, and the exercise of other remedies or procedures shall not be a bar to criminal prosecution for the same act or offense, and conversely, the prosecution of any person criminally shall not constitute a waiver of, or an election not to pursue other remedies which the city may have in connection with the same subject matter.
