Chapter 16.36 — PRIVATE STREETS, WAYS AND COMMON DRIVEWAYS

§ 16.36.010 MAINTENANCE—DUTIES OF OWNERS.

All existing streets, ways and common driveways shall be maintained by the owners of lots or building sites receiving access therefrom in such a manner that adequate access by vehicular traffic is provided at all times so that fire, police, health and sanitation vehicles, and public utility vehicles can service the properties contiguous or adjacent thereto, and so that said vehicles will have adequate turning areas. If said private streets, ways and common driveways are not maintained as provided in this section, and when the City Engineer determines that the maintenance and turning facilities are inadequate to provide safe access for the city vehicles using same, then public refuse and garbage collection and/or other similar services may be withheld from the property owners until adequate, safe access for such vehicles is provided.

§ 16.36.020 MAINTENANCE—REPAIRS BY CITY WHEN PUBLIC SAFETY IS THREATENED—COSTS.

Where danger from fire and/or flood requires the maintenance of adequate access facilities in order that the city may be in a position to protect the public health, safety and welfare, then the city, after posting notices on the lots or building sites receiving access from a private street, way and common driveways, and/or by sending notices to such property owners as shown on the latest county assessment roll, shall make the needed repairs and improvements and said owners shall be liable for such costs.

§ 16.36.030 MAINTENANCE—CONDITIONS, COVENANTS AND RESTRICTIONS—ASSESSMENT DISTRICTS.

All newly created common driveways shall have recorded conditions, covenants and restrictions to assure maintenance. All newly created private streets shall be maintained through assessment districts or conditions, covenants and restrictions. Appropriate mechanism to be determined by the city.
